Synopsis History of the Roman-Dutch Law by : J. W. Wessels

AN IMPORTANT BRANCH OF EUROPEAN CIVIL LAW. Origianlly published: Grahamstown, Cape Colony: African Book Co., 1908. iv (new introduction), xv, 791 pp. With a New Introduction by Michael Hoeflich, John H. & John M. Kane Professor of Law, University of Kansas School of Law. Roman-Dutch law is a hybrid of medieval Dutch law, mainly Germanic in origin, and Roman law as defined by the Corpus Juris Civilis and its later reception. It was developed in Holland during the sixteenth, seventeenth and eighteenth centuries. Bynkershoek, Damhouder, Grotius and other Roman-Dutch jurists had a profound influence on the development of European civil law and were the primary source of civil-law study in America. The Dutch brought it to their colonies, most notably South Africa and Indonesia, and it became the basis of their post-colonial legal systems. This engagingly written history offers a thorough analysis of Roman-Dutch jurisprudence and its intellectual background. Wessels devotes a great deal of attention to its literature, and he analyzes several treatises at length. Valuable as an introduction to one of the most important legal systems in history, it is equally useful as a reference. "On the whole, the work is deserving of high praise, both for its learning and its literary quality. It will prove a most illuminating adjunct to the standard authorities on this system of law." --JAMES MACKINTOSH, Juridical Review 20 (1908-1909) 370. JOHANNES WILHELMUS WESSELS [1862-1936] was a judge of the Transvaal Supreme Court. His works include The Status of the Uitlander (1894), Codification of Law in South Africa (1927) and The Law of Contract in South Africa (1937). MICHAEL H. HOEFLICH is the John H. & John M. Kane Professor of Law at the University of Kansas School of Law. He is the author of numerous books including Roman and Civil Law and the Development of Anglo-American Jurisprudence (1997), Legal Publishing in Antebellum America (2010), Sources of the History of the American Law of Lawyering (2007) and The Law in Postcards and Ephemera 1890-1962 (2012), the latter two published by The Lawbook Exchange, Ltd.

Synopsis Historical Dictionary of Lesotho by : Rosenberg

Although Lesotho is a small state never likely to be a major player in global affairs, its special interactions with South Africa make it a prototype for regional cooperation. Joint action by South Africa's and Botswana's military forces to end anarchy and preserve democracy in Lesotho serves as an important test case of regional peacekeeping in Africa. This reference provides comprehensive entries on historical events and personalities and focuses especially on the Basotho who have shaped Lesotho's development rather than on colonial officials and other expatriates. Greatest attention is given to the events, institutions, issues, personalities, places and external relationships of the post-independence era. The bibliography introduces a plethora of newer publications about Lesotho that have supplanted the rather sparse published literature previously available. An extensive chronology of Lesotho's evolution is included. The authors range of professional expertise and ability to compliment each author's areas of specialization. Offers in depth coverage of the most crucial events and participants in Lesotho's development.

Synopsis Law of Defamation in Commonwealth Africa by : Jill Cottrell

First published in 1998, this book is an exposition of the law of defamation as it applies in those countries (excluding South Africa). It discusses or refers to hundreds of cases from those jurisdictions, as well as many important precedents from England, analysing the law and discussing how far the courts have developed their own approaches to the law, and to what extent the law reflects the values of traditional society and customary law. It thus shows how the law is being used in a field which is both intensely political and reflects important social interests. Though directed mainly at legal practitioners, teachers and students, therefore, it would be of interest to the media – the defendants in the overwhelming majority of the cases-and to scholars in the social sciences.

Synopsis Mixed Jurisdictions Worldwide by : Vernon V. Palmer

Approximately 150 million people worldwide live in legal systems in which there is both a common law and a civil law content, yet there has been little comparative study of the experience of these 'mixed jurisdictions'. Here, the author considers these jurisdictions in a comparative framework, which includes their founding and raisons d'être, as well as the cultural divisions of the jurists and the evolutionary tendencies of their common and civil law components. In addition, he examines the internal contradictions between Anglo-American judicial institutions, methodologies and procedures, and the substantive civil law. The book argues that the legal systems of such far-flung and diverse cultures as the Philippines, Quebec, Scotland and South Africa have many unique and fruitful points of comparison. The conclusion is that these mixed jurisdictions form a closely related 'Third Legal Family' with cohesive traits and tendencies.

Synopsis The Social Meanings of Money and Property by : Kenneth O. Doyle

"In ′The Social Meanings of Money and Property′ Kenneth O. Doyle has produced an intriguing study that lays the groundwork for understanding the role played by money and property among individuals, groups and even nationalities. The toughminded/tender minded dichotomy presented in The Social Meanings of Money and Property can also be viewed as the Conservative/Liberal conflict. Conservatives demand self-reliance and Liberals crave nurture. The Social Meanings of Money and Property is first a psychological treatise, second it is a stimulant for complex thought." —W.J. Rayment, Conservativebookstore.com "A most important study... in the grand style of a Joseph Schumpeter.... [It] will reward both the expert and the general reader." —Matthew Lamb, Boston College "Kenneth O. Doyle′s book, The Social Meanings of Money and Property, is one of the most wide-ranging and scholarly books I have ever read. . . .The comprehensiveness of the scholarship Doyle amasses will undoubtedly stimulate scholars from a variety of disciplines to test out the implications of the model." –Wilbert J. McKeachie, University of Michigan Why would a man with more money than he could ever spend risk career, family, and freedom for a modest increase in net worth? Why would a woman who never cared at all about investments perjure herself for a better divorce settlement? Why do people of some cultures seem inclined toward economic success? What are the fundamental differences between conservatives and liberals, or capitalists and socialists? Is there any hope of rapprochement between Economic Man and Psychological Man? In this book, Professor Kenneth O. Doyle spells out a theoretical system for understanding these practical, everyday problems, using a conceptual framework for studying the social meanings of money and property. He finds fundamental meaning in the concept of talisman. We use money and property, he proposes, to protect ourselves from fears characteristic of our personalities: the fear of incompetence, the fear of abandonment, the fear of disarray, and the fear of constraint. The Social Meanings of Money and Property will be of interest to scholars and students across a number of disciplines, including, but by no means limited to, psychology, sociology, and economics.
