How safe is our food supply? Each year the media report what appears to be growing concern related to illness caused by the food consumed by Americans. These food borne illnesses are caused by pathogenic microorganisms, pesticide residues, and food additives. Recent actions taken at the federal, state, and local levels in response to the increase in reported incidences of food borne illnesses point to the need to evaluate the food safety system in the United States. This book assesses the effectiveness of the current food safety system and provides recommendations on changes needed to ensure an effective science-based food safety system. Ensuring Safe Food discusses such important issues as: What are the primary hazards associated with the food supply? What gaps exist in the current system for ensuring a safe food supply? What effects do trends in food consumption have on food safety? The increasing globalization of food trade and the harmonization of food standards and food safety rules have led to significant changes in the international and national regulatory frameworks for food. There is an increasing recognition of the need to integrate and improve coordination of regulatory activities among national and international bodies for better protection of human, animal and plant life and health without creating unnecessary barriers to trade. In addition, catastrophic outbreaks of food-borne disease have sparked increasing attention to the regulatory frameworks for food safety and food trade in the global arena. These developments have given rise to new legislative needs. National regulatory frameworks have to be adjusted to meet international and regional obligations, while the distribution of responsibilities for the food sector requires rigorous review. The present text draws on FAO's experience in providing technical assistance to governments developing new food laws and regulations, setting out and examining the many elements of the national system which should be taken into account in a comprehensive review of national regulatory frameworks for food. Towards that end, the text offers concrete recommendations for the preparation of a basic national food law, including three variants of a new model food law.

As the pressure on finite resources of freshwater resources increases, government-administered legislation is taking a more dominant role in water resources management and protection. This manual is intended to bridge the gap between the policy and principles of the resultant primary legislation and implementation through secondary legislation. It covers a variety of legislative approaches cvoering all aspects of water resource management from water rights & permits, pollution prevention & control; conservation; flood control; irrigation; drainage and charging. It is an update of of the earlier FAO Legislative Study No. 52 (1994). Like its predecessor, it provides conceptual material for use in the preparation of national regulations for the management, development, use and protection of freshwater resources.

Fisheries law enforcement, from investigation to judgement, continues to be an expensive and lengthy process in many jurisdictions. Many countries - particularly developing countries - experience such a significant backlog of pending trials for conventional criminal offences that dealing with fisheries offences is not a priority. This study suggests considering the use of administrative sanctions as a direct response to the problem and examines the administrative systems for dealing with fisheries offences in a diverse range of countries from different legal systems. It is intended to assist states in identifying the issues they need to take into account when considering the adoption of such a scheme. It is expected that the study will be especially valuable to developing states seeking to adopt a cost effective means of dealing with illegal, unreported and unregulated fishing, but which nonetheless wish to ensure that the basic individual rights of the accused are protected.

This legislative study describes the new approach of the international plant quarantine system following the implementation of the Agreement on the Application of Sanitary and Phytosanitary Measures. It demonstrates the renewed importance of the International Plant Protection Convention, which has now become the established instrument for drafting plant health standards recognised by the World Trade Organization (WTO). Some specific cases are cited, mainly the United States (US), the European Union (EU), and some African and Asian countries.

In natural disaster or violent conflict situations, the right to food of innocent people is often endangered. Disruption in food production and distribution, looting and blockades, destruction of crops and mining of agricultural land are some of the common problems which occur. This study examines the international legal framework to protect the right to adequate food in emergencies, exploring human rights, economic and environmental aspects. Issues discussed include: principles of humanitarian access, duties of the international community, interventions by the UN Security Council, crimes against humanity and the ban on deliberate starvation of civilians, and standards of food related aid.

This study is a contribution of the FAO Development Law Service to the discussion on rights-based systems in fisheries management from a legal perspective. It outlines the history of the development of rights-based fisheries management, the concepts of property rights in fisheries and the terms used in property rights regimes, the governing legislation in jurisdictions which have introduced property rights in fisheries, the interpretation placed by the courts of the jurisdiction on that legislation, and the possible options for implementing property-based fisheries rights systems in national legislation.
