This legislative study describes the new approach of the international plant quarantine system following the implementation of the Agreement on the Application of Sanitary and Phytosanitary Measures. It demonstrates the renewed importance of the International Plant Protection Convention, which has now become the established instrument for drafting plant health standards recognised by the World Trade Organization (WTO). Some specific cases are cited, mainly the United States (US), the European Union (EU), and some African and Asian countries.

This publication covers all the major aspects of CITES implementation, stresses the role of Resolutions and contains recommendations for specific measures that might be taken by the Parties. It is a reference for any Party that is faced with enacting legislation for the adequate implementation of CITES.

This book presents a comprehensive compilation of registration requirements necessary for authorisation of biological control agents (viruses, bacteria, fungi, active substances of natural origin and semiochemicals) in OECD countries. It also reviews data requirements for invertebrate agents (insect, mites and nematodes) and provides proposals for harmonisation of the regulation process and guidelines for completion of application forms. Based on results of the EU REBECA Policy Support Action, which gathered experts from academia, regulation authorities and industry, risks and benefits of the specific agents were reviewed and proposals for a more balanced registration process elaborated, including recommendations for acceleration of the authorisation process and discussions on trade-off effects and policy impacts. All these aspects are covered in detail in this book, which points the way forward for enhanced utilisation of biological control agents.

This companion volume to An Introduction to the WTO Agreements looks at how the WTO agreements represent progress over the GATT rules they have replaced. The author also analyses their deficiencies and imbalances from the point of view of the developing countries. And he proposes detailed changes (and strategies) which, in his view, the countries of the South ought now to be putting forward in the next round of negotiations on trade and related issues which have already commenced.

The study provides an overview of the international intellectual property system regulating plant varieties. It identifies the essential features of this system, including the policies supporting the grant of intellectual property rights (IPRs) and the societal objectives in tension with IPRs, the institutions that have shaped the international intellectual property system, and the basic components contained in the relevant international treaties. The study aims to set forth regulatory options for national governments to protect plant varieties while achieving other public policy objectives relating to plant genetic resources.

This anchor volume to the series Managing Global Genetic Resources examines the structure that underlies efforts to preserve genetic material, including the worldwide network of genetic collections; the role of biotechnology; and a host of issues that surround management and use. The purpose of the Guide is to support national plant protection organizations (NPPOs) who wish to establish and maintain pest free areas (PFA) including places and/or production sites (PFPP and PFPS) as well as areas of low pest prevalence (ALPP). To facilitate an understanding of the processes to establish and maintain PFAs and ALPPs, a diagram in the form of a decision tree was constructed that identifies and outlines five general phases of programme development as follows: initiation, feasibility, establishment, maintenance, and market access phases. The guide is then divided into corresponding sections that describe what the key elements of each phase are, why these elements are important, what some of the common challenges and pitfalls are, and factors that may influence the success of the different phases such as budget stability, public outreach, availability of good survey and control tools, and open engagement with stakeholders and trading partners. By providing a deeper understanding of the factors that should be considered when establishing a PFA, PFPP, PFPS or ALPP the guide aims to overcome the challenges and maximize the impact of these efforts to the benefit of all parties. The guide concludes by providing a number of case studies from around the world that highlight successful PFA and ALPP programmes and how they deal with particular key issues. This guide contains current experience and the most advanced phytosanitary procedures in the implementation of PFA and ALPP, however, it is subjected to revision and updates as new developments are made available.

Deep trade agreements (DTAs) cover not just trade but additional policy areas, such as international flows of investment and labor and the protection of intellectual property rights and the environment. Their goal is integration beyond trade or deep integration. These agreements matter for economic development. Their rules influence how countries (and hence, the people and firms that live and operate within them) transact, invest, work, and ultimately, develop. Trade and investment regimes determine the extent of economic integration, competition rules affect economic efficiency, intellectual property rights matter for innovation, and environmental and labor rules contribute to environmental and social outcomes. This Handbook provides the tools and data needed to analyze these new dimensions of integration and to assess the content and consequences of DTAs. The Handbook and the accompanying database are the result of collaboration between experts in different policy areas from academia and other international organizations, including the International Trade Centre (ITC), Organisation for Economic Co-operation and Development (OECD), United Nations Conference on Trade and Development (UNCTAD), and World Trade Organization (WTO).

International and national legal frameworks governing the trade and use of pesticides have undergone significant changes over the last twenty years. The International Code of Conduct on the Distribution and Use of Pesticides, the Rotterdam Convention, the Stockholm Convention, the Basel Convention and the Montreal Protocol are only some of the binding and non-binding international instruments applicable to part or all of the life cycle of a pesticide. Specific guidelines for implementation are often available from the secretariat of the applicable international instrument, but comprehensive guidance is generally lacking. Governments need a clear picture of their international obligations as well as guidance on the accepted international consensus on the proper management of pesticides. Upgraded national legislation is needed to align national frameworks with international norms. This text aims to provide governments wishing to design, reform or update their national legislation with up-to-date advice on all aspects of pesticide management. Although the recommendations for national legislative change are designed to be useful to all countries, the text highlights the particular problems faced by developing countries and countries in transition, offering practical solutions to common problems. Genetically engineered (GE) crops were first introduced commercially in the 1990s. After two decades of production, some groups and individuals remain critical of the technology based on their concerns about possible adverse effects on human health, the environment, and ethical considerations. At the same time, others are concerned that the technology is not reaching its potential to improve human health and the environment because of stringent regulations and reduced public funding to develop products offering more benefits to society. While the debate about these and other questions related to the genetic engineering techniques of the first 20 years goes on, emerging genetic-engineering technologies are adding new complexities to the conversation. Genetically Engineered Crops builds on previous related Academies reports published between 1987 and 2010 by undertaking a retrospective examination of the purported positive and adverse effects of GE crops and to anticipate what emerging genetic-engineering technologies hold for the future. This report indicates where there are uncertainties about the economic, agronomic, health, safety, or other impacts of GE crops and food, and makes recommendations to fill gaps in safety assessments, increase regulatory clarity, and improve innovations in and access to GE technology.
