Numerous countries and regions now have very active space programs, and the number is increasing. These maturing capabilities around the world create a plethora of potential partners for cooperative space endeavors, while at the same time heightening competitiveness in the international space arena. This book summarizes a public workshop held in November 2008 for the purpose of reviewing past and present cooperation, coordination, and competition mechanisms for space and Earth science research and space exploration; identifying significant lessons learned; and discussing how those lessons could best be applied in the future, particularly in the areas of cooperation and collaboration. Presentations and initial discussion focused on past and present experiences in international cooperation and competition to identify "lessons learned." Those lessons learned were then used as the starting point for subsequent discussions on the most effective ways for structuring future cooperation or coordination in space and Earth science research and space exploration. The goal of the workshop was not to develop a specific model for future cooperation or coordination, but rather to explore the advantages and disadvantages of various approaches and stimulate further deliberation on this important topic.

It is a remarkable achievement to write a book that almost four decades after its publication has lost virtually none of its relevance. Manfred Lachs’ famous treatise on the Law of Outer Space was originally published in 1972, yet it is still a classic and must-read text for space law students today, even though copies can nowadays be rarely found. The reissue of this remarkable work is therefore timely indeed. Its aim is to make the brilliance, foresight and clarity of Lachs’ thinking once more easily accessible to a new generation of scholars. Issued on the occasion of the 50th anniversary of the International Institute of Space Law, of which Lachs was President, this volume reproduces the original text of Lachs' work in full, with a new preface, introduction and index supplied by the editors.

This is a policy oriented and comparatively oriented textbook on air and space law for students and practitioners. It covers the history and development in air and space law; their interrelationships with the law of the seas and the law of Antartica; institutions working in the field of air and space law; sovereignty in national penal air law; private international air law, especially liability law; and public and private space law Much attention is devoted to the law of air commerce: bilateral air services agreements; inter-airline co-operation; the effect of competition, antitrust and European Union law; deregulation, privatization and commercialization of air transport; ownership and control of airlines, and airline alliances; multilateralisation of air transport; and congestion and environmental controls. The last chapter of the book briefly deals with the legal aspects of commercial outer space application. Increasingly, air transport, both in fact and in law, is becoming an ordinary industry like any other and is being treated as such. Rapidly, commercial outer space activities are being privatized and commercialized.

The very nature of international air transportation and outer space activities means that they have an international perspective. This is more evident today than at any time in the past, due to the intensification of trans-boundary trade, the internationalization of the division of work and the acceleration of technological progress. The Asian Institute of Air and Space Law, the Graduate School of Law, Soochow University, Taipei, the International Institute of Air and Space Law, Leiden University, and the Institute of Air and Space Law, McGill University, have instituted international conferences in order to provide a world platform for eminent specialists and scholars. The Tokyo Conference, upon which this excellent collection of papers is based, was concerned with a wide range of legal and practical questions arising from regulatory developments in international air transportation and in the exploration, exploitation and use of outer space and celestial bodies. The main topics of deliberation were: megacarriers in the 21st century, the need to revise the Bermuda Capacity Formula and the Chicago Convention, liability and responsibility in international aviation, safety, security and environment, airline industry competition, legal and political aspects of space transportation and manned space flights, the protection of the space environment and dispute settlement in air and space law. They are discussed in this volume with unparalleled authority.

The applications and uses of satellite remote sensing have burgeoned during the last decade and the associated legal aspects of satellite remote sensing have become increasingly important, however, the legal regime in this area is surprisingly inadequate. The research undertaken for this book provides, for the first time in one place, an examination of the existing regime and highlights shortcomings with regard to liability, data policy and data integrity before proposing improvements needed for the full beneficial exploitation of remotely sensed data, particularly in support of disaster management and the protection of the environment.

This book examines transatlantic politics through an analysis of 60 years of US-European strategic interaction in space. The significance of space politics for the study of transatlantic relations receives surprisingly little scholarly attention. As a theatre of interaction, transatlantic space politics reflects the vicissitudes of European and US power in the international system. An understanding of space politics is therefore vital in understanding the status and prospect of the transatlantic order. Using established IR theories, the author investigates transatlantic space politics and proposes a theoretical explanation, which is distinct from the conventional wisdom of the transatlantic security community. More specifically, he distinguishes between the constitutive and regulatory effects of the transatlantic security community, an approach rarely employed in other research in the field. Overall, this book suggests not only that the transatlantic institutional pillar requires repair, but also that the ideational factors need to be revitalised in order to consolidate the transatlantic alliance. Aviation Law and Policy in Asia: Smart Regulation in Liberalised Markets investigates the regulatory and business dimensions of aviation law and policy in Asia and serve as a roadmap for understanding aviation law and policy in Asia.

This book indicates the shortcomings of the current international legal system and customary international norms that govern international aviation law to comply with contemporary air transport market realities. As the air transport market develops globally, the safety regime of civil aviation should also be governed and applied globally. In this book, the author departs from current international legal norms to examine the emerging legal field of global administrative law. Through that lens, the possibility of reconstructing the set of legal mechanisms that govern domestic and international administrative interaction in the global field of aviation safety is explored. This book demonstrates that a legal system is never complete but always develops in tandem with changing needs, i.e. the participation of the affected parties. Exploring the principles of GAL theory contributes to addressing the contemporary legal issues relating to state compliance with international aviation safety standards that would otherwise not be covered by customary international law. In particular, the principles of GAL theory regarding global governance and the ‘public’ character of global regulations, the role of individuals and states in global governance, and state sovereignty are considered valuable contributions to contemporary global aviation safety issues in practice. It is asserted in this book that proper checks and balances in global aviation safety can be improved by making these accessible to individuals by way of national courts. Finally, establishing public awareness of global aviation safety standards will eventually create greater pressure on states to implement and enforce them.
