The papers deal with the influence of the Code upon common-law countries in their efforts to manage statute and case law and gives examples of modern attempts at restatement of the law and uniform state laws as examples of the effect of the Code's coherence and logic. The papers were given by notable legal scholars such as Benjamin Akzin, Ren Cassin, C.J. Friedrich, Arthur von Mehren, Roscoe Pound, Thibadeau Rinfret, Max Rheinstein, Angelo Piero Sereni, Jack Bernard Tate and Arthur T. Vanderbilt. At the time of these lectures Schwartz was Director of the Institute. Includes a bibliography by Julius J. Marke. Reprint of the first edition. BERNARD SCHWARTZ 1923-1997] was professor of law and director of the Institute of Comparative Law, New York University. Bryant Barrett was an English attorney and member of Gray's Inn. His superb translation is noteworthy in part because it was published the year the Code was enacted. As such, it has the advantage of being in a style of English that is an idiomatic contemporary to the original French. Many scholars believe that this is the finest translation of the Code. Indeed, they have found it to be more accurate than the official Louisiana edition. Barrett's index, which follows the style of English lawyer's common-place books and abridgments, is a thorough guide to the Code. The philological basis of his 393-page introduction had a profound influence on the subsequent development of Classical British legal ethnography.

Code Napoleon, the first code of the French civil law, known at first as the Code civil des Français, was promulgated in its entirety by a law of the 30th Ventose in the year XII. (31st of March 1804). The influence of the Code Civil has been very great, not only in France but also abroad. Belgium has preserved it, and the Rhine provinces only ceased to be subject to it on the promulgation of the civil code of the German empire. Its ascendancy has been due chiefly to the clearness of its provisions, and to the spirit of equity and equality which inspires them. Numerous more recent codes have also taken it as a model: the Dutch code, the Italian, and the code of Portugal; and, more remotely, the Spanish code, and those of the Central and South American republics.

General Franceschi and Ben Weider dismantle this false conclusion in The Wars Against Napoleon, a brilliantly written and researched study that turns our understanding of the French emperor on its head. Avoiding the simplistic clichés and rudimentary caricatures many historians use when discussing Napoleon, Franceschi and Weider argue persuasively that the caricature of the megalomaniac conqueror who bled Europe white to satisfy his delirious ambitions and insatiable love for war is groundless. By carefully scrutinizing the facts of the period and scrupulously avoiding the sometimes confusing cause and effect of major historical events, they paint a compelling portrait of a fundamentally pacifist Napoleon, one completely at odds with modern scholarly thought. This rigorous intellectual presentation is based upon three principal themes. The first explains how an unavoidable belligerent situation existed after the French Revolution of 1789. The new France inherited by Napoleon was faced with the implacable hatred of reactionary European monarchies determined to restore the ancient regime. The second theme emphasizes Napoleon’s determined efforts (“bordering on an obsession,” argue the authors) to avoid this inevitable conflict. The political strategy of the Consulate and the Empire was based on the intangible principle of preventing or avoiding these wars, not on conquering territory. Finally, the authors examine, conflict by conflict, the evidence that Napoleon never declared war. As he later explained at Saint Helena, it was he who was always attacked—not the other way around. His adversaries pressured and even forced the Emperor to employ his unequalled military genius. After each of his memorable victories Napoleon offered concessions, often extravagant ones, to the defeated enemy for the sole purpose of avoiding another war.
