Synopsis Reshaping the Investor-State Dispute Settlement System by : Jean E. Kalicki

In Reshaping the Investor-State Dispute Settlement System: Journeys for the 21st Century, editors Jean E. Kalicki and Anna Joubin-Bret offer for the first time a broad compendium of practical suggestions for reform of the current system of resolving international investment treaty disputes. The increase in cases against States and their challenge to public policy measures has generated a strong debate, usually framed by complaints about a perceived lack of legitimacy, consistency and predictability. While some ideas have been proposed for improvement, there has never before been a book systematically focusing on constructive paths forward. This volume features 38 chapters by almost 50 leading contributors, all offering concrete proposals to improve the ISDS system for the 21st century.

Synopsis Human Population Genetic Research in Developing Countries by : Yue Wang

Human population genetic research (HPGR) seeks to identify the diversity and variation of the human genome and how human group and individual genetic diversity has developed. This book asks whether developing countries are well prepared for the ethical and legal conduct of human population genetic research, with specific regard to vulnerable target group protection. The book highlights particular issues raised by genetic research on populations as a whole, such as the potential harm specific groups may suffer in genetic research, and the capacity for current frameworks of Western developed countries to provide adequate protections for these target populations. Using The People’s Republic of China as a key example, Yue Wang argues that since the target groups of HPGR are almost always from isolated and rural areas of developing countries, the ethical and legal frameworks for human subject protection need to be reconsidered in order to eliminate, or at least reduce, the vulnerability of those groups. While most discussion in this field focuses on the impact of genetic research on individuals, this book breaks new ground in exploring how the interests of target groups are also seriously implicated in genetic work. In evaluating current regulations concerning prevention of harm to vulnerable groups, the book also puts forward an alternative model for group protection in the context of human population genetic research in developing countries. The book will be of great interest to students and academics of medical law, ethics, and the implications of genetic research.

Synopsis Elections in Times of a Pandemic – Dilemmas and Challenges by :

The COVID-19 pandemic demonstrated that unexpected and unpredictable situations can hinder the conduct of general elections around the world. The book is a comprehensive analysis of the organization of elections during the COVID-19 pandemic. In addition to the theoretical perspective, it familiarizes the public with specific electoral solutions adopted during the pandemic in selected European countries (Italy, Germany, Lithuania, Serbia, Russia, Czech Republic, Estonia, Latvia, Liechtenstein, Poland). The editors believe that this book will bring closer the specific solutions adopted in the considered countries during the COVID-19 pandemic and provide readers with a multi-faceted understanding of elections in emergency situations. Synopsis A Degraded Caste of Society by : Andrew T. Fede

A Degraded Caste of Society traces the origins of twenty-first-century cases of interracial violence to the separate and unequal protection principles of the criminal law of enslavement in the southern United States. Andrew T. Fede explains how antebellum appellate court opinions and statutes, when read in a context that includes newspaper articles and trial court and census records, extended this doctrine to the South’s free Black people, consigning them to what South Carolina justice John Belton O’Neall called “a degraded caste of society,” in which they were “in no respect, on a perfect equality with the white man.” This written law either criminalized Black insolence or privileged private white interracial violence, which became a badge of slavery that continued to influence the law in action, contrary to the Constitution’s mandate of equal protection of the criminal law. The U.S. Supreme Court enabled this denial of equal justice, as did Congress, which did not make all private white racially motivated violence a crime until 2009, when it adopted the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act. Fede’s analysis supports that law’s constitutionality under the Thirteenth Amendment, while suggesting why—during the Jim Crow era and beyond—equal protection of the criminal law was not always realized, and why the curse of interracial violence has been a lingering badge of slavery.

Synopsis Procedural Justice and Relational Theory by : Denise Meyerson

This book bridges a scholarly divide between empirical and normative theorizing about procedural justice in the context of relations of power between citizens and the state. Empirical research establishes that people’s understanding of procedural justice is shaped by relational factors. A central premise of this volume is that this research is significant but needs to be complemented by normative theorizing that draws on relational theories of ethics and justice to explain the moral significance of procedures and make normative sense of people’s concerns about relational factors. The chapters in Part 1 provide comprehensive reviews of empirical studies of procedural justice in policing, courts and prisons. Part 2 explores empirical and normative perspectives on procedural justice and legitimacy. Part 3 examines philosophical approaches to procedural justice. Part 4 considers the implications of a relational perspective for the design of procedures in a range of legal contexts. This collection will be of interest to a wide academic readership in philosophy, law, psychology and criminology.

Synopsis Complexities and challenges in preventive audiology by : Katijah Khoza-Shangase

The success of any preventive healthcare programme is reliant on a functional healthcare system. Within this system of care, healthcare professionals, including audiologists, can only practice safely and effectively if they possess an appreciation of the complexities and challenges that exist in that context. Where healthcare professionals have such awareness that aids them to recognise opportunities for errors that can cause patients harm and where they take steps to prevent these mistakes is where preventive audiology is positioned. This edited book, Complexities and Challenges in Preventive Audiology: An African Perspective, is a sequel to another book by the current editor titled Preventive Audiology: An African Perspective. While in the process of editing that book, the editor identified that a lacuna of contextually relevant collation of evidence on complexities and challenges faced by the field of audiology within the African context in implementing preventive audiology existed. The goal of this book is to delve into these complexities and challenges for various key areas in audiology. All chapters deliberate on evidence-based perspectives grounded in the African context, with deliberate and preferential reliance on contemporary locally relevant evidence that allows for accurate reflection of current complexities and challenges in ear and hearing care delivery within the African context. Contributors were encouraged to be as comprehensive as possible in their review of the literature within the African context, where available. Complexities brought about by context, such as cultural and linguistic diversity as well as traditional and alternative healthcare, on preventive audiology within the South African context, are also covered in this book. As each chapter explores prevailing complexities and challenges, potential solutions and recommendations for all challenges identified are also offered, having carefully and deliberately engaged with local evidence, local context, and local policies and regulations to ensure an Afrocentric contribution to the world of evidence. All chapters in the book have a goal of ensuring that increased efforts are directed towards the provision of clinical services that are driven through best practice by contextually relevant and responsive evidence.
