An interdisciplinary anthology on the intersections of gender, Islam, and law

Contradicting the views commonly held by westerners, many Muslim countries in fact engage in a wide spectrum of reform, with the status of women as a central dimension. This anthology counters the myth that Islam and feminism are always or necessarily in opposition. A multidisciplinary group of scholars examine ideology, practice, and reform efforts in the areas of marriage, divorce, abortion, violence against women, inheritance, and female circumcision across the Islamic world, illuminating how religious and cultural prescriptions interact with legal norms, affecting change in sometimes surprising ways.

A Nation Can Rise No Higher Than Its Women: African American Muslim Women in the Movement for Black Self Determination, 1950–1975 challenges traditional notions and interpretations of African American, particularly women who joined the Original Nation of Islam during the Civil Rights-Black Power era. This book is the first major investigation of the subject that engages a wide scope of women from “The Nation” and utilizes a wealth of primary documents and personal interviews to reveal the importance of women in this community. Why are so few people talking about the eruption of sexual violence and harassment in Europe’s cities? No one in a position of power wants to admit that the problem is linked to the arrival of several million migrants—most of them young men—from Muslim-majority countries. The publication identifies the causes and consequences of gender inequality in the Middle East, and provides concrete recommendations for national and international policymakers and implementers. Freedom House is an independent nongovernmental organization that supports democratic change, monitors freedom, and advocates for democracy and human rights. The project has been embraced as a resource not only by international players like the United Nations and the World Bank, but also by regional womenOs rights organizations, individual activists, scholars, and governments worldwide. WomenOs rights in each country are assessed in five key areas: (1) Nondiscrimination and Access to Justice; (2) Autonomy, Security, and Freedom of the Person; (3) Economic Rights and Equal Opportunity; (4) Political Rights and Civic Voice; and (5) Social and Cultural Rights. This book investigates agency in the historical resistance movement in Kashmir by initiating a fresh conversation about Muslim Kashmiri women. It exhibits Muslim women not merely as accidental victims but conscientious agents who choose to operate within the struggles of self-determination. The experience of victimization stimulates women to take control of their lives and press for change. Despite experiencing isolating political conditions, Kashmiri women do not internalize their supposed inferiority. The author shows that women’s struggles against patriarchy are at the heart of a very complex historical resistance to the Indian rule.

Living in pluralist India has had critical consequences for Muslim women who are expected to follow a determined and strict code of conduct. The impact of this contradiction is most evident in the continuing denial of gender equality within the family, as state regulation of gender roles in the private sphere ultimately affects the status of women in the public sphere. Reclaiming the Nation examines the relationship between gender and nation in post-colonial India through the lens of marginalized Muslim women. Drawing on feminist legal theory, postcolonial feminist theory, and critical race theory, Vrinda Narain explores the idea of citizenship as a potential vehicle for the emancipation of Muslim women. Citizenship, Narain argues, opens the possibility for Indian women to reclaim a sense of selfhood free from imposed identities. Toward an Islamic Reformation is an ambitious attempt to modernize Islamic law, calling for reform of the historical formulations of Islamic law, commonly known as Shari'a that is perceived by many Muslims to be part of the Islamic faith. As a Muslim, Abdullahi Ahmed An-Na'im is sensitive to and appreciative of the delicate relationship between Islam as a religion and Islamic law. Nevertheless, he considers that the questions raised here must be resolved if the public law of Islam is to be implemented today. An-Na'im draws upon the teachings and writings of Sudanese reformer Mahmoud Mohamed Taha to provide what some have called the intellectual foundations for a total reinterpretation of the nature and meaning of Islamic public law.
