Logistics infrastructures are critical for social and economic development. Enhancing infrastructures has therefore become a central theme for governments internationally. Given the state of public finances in Brazil, the key challenge is how to attract sufficient private investment into infrastructures so as to achieve social and economic development. This report deals with the regulation of logistics infrastructures in Brazil, focusing in particular on the federal level. Brazil, one of the key emerging economies in the world, has a particular need for developing logistics infrastructures. Past initiatives however have suffered from a lack of strategic perspective and from poor regulatory capacity. They have encouraged poor strategic investments and a ‘gaming culture’ among concession holders. The latest reforms have sought to strengthen the credibility and predictability of regulatory frameworks to attract ‘better’ and ‘new’ private investment into expanding Brazil’s logistics infrastructure. This report argues that such an approach towards regulation is unlikely to be sufficient. Instead, it argues for a renewed focus on regulatory governance and regulatory capacity. This study therefore is interested in developing insights and recommendations that both serve the development of regulatory capacity in Brazil – a country that has witnessed considerable investment into its regulatory frameworks over the past two decades – and address sector-specific challenges.

A partial equilibrium model as a Mixed Complementarity Problem (MCP) was developed to guide the implementation of more effective policies and support new investments. The Cartagena Protocol on Biosafety requirements affects the logistics of transport and storage in Brazil. Intermodal flows were most affected and significant commercial reductions occurred in the regions farthest from export ports. This research is original in its use of a model and forecast scenarios to measure how biotechnology regulatory issues directly affect infrastructure logistics. Establishing stringent identity preservation systems affects these projects, since intermodal flows are most affected by such systems.

In the 1990s, Brazilian policy-makers adopted a series of liberalizing economic reforms that exposed the poor condition of logistics infrastructure and inadequate investment in Brazilian ports, roads, railways and airports. Over twenty years later, the implications of those reforms still colour Brazil’s prospects for development. Mahrukh Doctor’s book evaluates the political economy of reform in Brazil and the difficulty of implementing institutional modernization in the context of opposition from vested interests originating in the state and civil society. It focuses specifically on the Port Modernization Law, which aimed to augment the country's competitiveness by creating efficient and low cost ports. Based on primary research carried out over a period of twenty years using original qualitative data, Doctor’s analysis focuses on the difficulties in implementing this law and how those difficulties are symptomatic of the wider issues associated with lack of sufficient investment in infrastructure in Brazil. Using the case of the business lobby for port reform, the book examines the evolving nature of business-state relations and the process of institutional change in Brazil. The main objectives of regulatory reform and privatization of infrastructure in Brazil were to attract new private investment, increase efficiency and reduce the public debt through the use of privatization revenues. Whereas the evidence suggests that regulatory reform (privatization included) has succeed in fostering productivity growth and improving the fiscal accounts, much less has been accomplished by way of raising investment levels. The telecom sector is apparently the only exception to this rule. What accounts for the failure of privatization and regulatory reform to produce the expected boom in infrastructure investment? Was it an error in diagnosis, faulted implementation or lack of additional supporting reforms? What explains the atypical success observed in telecom? What lessons can be learned from this process and how can these be used to make the necessary corrections so as to produced the needed rise in infrastructure investment? This paper tries to answer these questions, reviewing and analyzing the process of regulatory reform in the main infrastructure sectors. In particular, it examines why has investment failed to expand more significantly. The paper discusses regulatory reform in the telecom, electricity, transportation, and water and sanitation sectors, and makes some recommendations for future action. It concludes that although much has been accomplished in reforming Brazilian infrastructure sectors, at least as much remains to be done.
