A wide range of crop genetic resources is vital for future food security. Loss of agricultural biodiversity increases the risk of relying on a limited number of staple food crops. However, many laws, such as seed laws, plant varieties protection and access and benefit-sharing laws, have direct impacts on agrobiodiversity, and their effects have been severely underestimated by policy-makers. This is of concern not only to lawyers, but also to agronomists, biologists, and social scientists, all of whom need clear guidance as to the relevance of the law to their work. This book analyzes the impact of the legal system on agrobiodiversity (or agricultural biodiversity) – the diversity of agricultural species, varieties, and ecosystems. Using an interdisciplinary approach, it takes up the emerging concept of agrobiodiversity and its relationship with food security, nutrition, health, environmental sustainability, and climate change. It assesses the impacts on agrobiodiversity of key legal instruments, including seeds laws, the International Convention for the Protection of New Varieties of Plants, plant breeders’ rights, the Convention on Biological Diversity (regarding specifically its impact on agrobiodiversity), and the International Treaty on Plant Genetic Resources for Food and Agriculture. It also reviews the options for the implementation of these instruments at the national level in several countries. It discusses the interfaces between the free software movement, the ‘commons’ movement, and seeds, as well as the legal instruments to protect cultural heritage and their application to safeguard agrobiodiversity-rich systems. Finally, it analyzes the role of protected areas and the possibility of using geographical indications to enhance the value of agrobiodiversity products and processes.

IUCN's Protected Areas Management Categories, which classify protected areas according to their management objectives, are today accepted as the benchmark for defining, recording, and classifying protected areas. They are recognized by international bodies such as the United Nations as well as many national governments. As a result, they are increasingly being incorporated into government legislation. These guidelines provide as much clarity as possible regarding the meaning and application of the Categories. They describe the definition of the Categories and discuss application in particular biomes and management approaches.

The book focuses on the relationship between nature conservation policies and landscape policies. This is a relevant subject due to the current need of reviving nature conservation policies, which are today affected by a general effectiveness deficiency. To this end, landscape policies can play a crucial role, bridging nature and culture, fostering more integrated approaches to nature conservation and stimulating the active participation of local communities. Crop wild relatives (CWR) are plant species which are more or less closely related to crops. They are a vital resource by providing a pool of genetic variation that can be used in breeding new and better adapted varieties of crops that are resistant to stress, disease, drought and other factors. They will be increasingly important in allowing crops to adapt to the impacts of climate, thus safeguarding future agricultural production. Until recently, the main conservation strategy adopted for CWR has been ex situ - through the maintenance of samples as seed or vegetative material in various kinds of genebank or other facilities. Now the need to conserve CWR in their natural surroundings (in situ) is increasingly recognized. Recent research co-ordinated by Bioversity International has produced a wealth of information on good practices and lessons learned for their effective conservation. This book captures the important practical experiences of countries participating in this work and describes them for the wider conservation community. It includes case studies and examples from Armenia, Bolivia, Madagascar, Sri Lanka and Uzbekistan, which are important centres of diversity for crop wild relatives, and covers four geographical regions - the Caucasus, South America, Africa and the Asia-Pacific Region. It provides practical, relevant information and guidance for the scaling-up of actions targeting CWR conservation around the world.

The Convention on Biological Diversity (CBD) strives for the sustainable and equitable utilization of genetic resources, with the ultimate goal of conserving biodiversity. The CBD and the Nagoya Protocol which has since been elaborated suggest a bilateral model for access to genetic resources and the sharing of benefits from their utilization. There is concern that the bilateral exchange "genetic resource for benefit sharing" could have disappointing results because providers are left out of the process of research and development, benefits are difficult to be traced to sources, and providers owning the same resource may complain of being excluded from benefit sharing. Thus, the CBD objective of full utilization and equitability may become flawed. Common Pools of Genetic Resources: Equity and Innovation in International Biodiversity Law suggests common pools as a complementary approach to bilateralism. This is one of the first books to reply to a number of complex legal questions related to the interpretation and implementation of the Nagoya Protocol. Taking an inductive approach, it describes existing pools and analyzes how they are organized and how they perform in terms of joint R&D and benefit sharing. It presents case studies of the most characteristic types of common pools, provides suggestions for further developing existing pools to cope with the requirements of the CBD and NP and, at the same time uses the clauses these conventions contain to open up for commons approaches.
