Synopsis Production Rights in European Agriculture by : D. Barthelemy
Rather than simply cataloging the various interpretations of European regulations by Member States, this international team examines the economic priorities, the legal bases, the social norms and cultural patterns which come into play, presenting an analytical approach to the study of production rights in European agriculture. This work traces the emergence and the economic and legal content of the different income support tools for agricultural producers, collectively termed 'production rights' and it looks at the foundations of the specific national conceptions underlying the methods of organising agricultural activity. The book is intended for a varied readership: farmers themselves, of course, but also economic, legal and tax consultants, experts, lawyers, notaries, as well as students, teachers and researchers. It has been set out in such a way as to allow readers to move freely from one subject to another, depending on whether their interest lies in economic aspects or legal developments, or whether they are more concerned by certain production rights or by certain features of their own organisation. The goal of the book is to enable the reader to grasp the special features and the significance of the forces which have shaped the current income support instruments for producers in the various Member States of the EU, and which will unquestionably continue to influence the measures which flow from reforms to the Common Agricultural Policy in the years to come.

Synopsis EU Agricultural Law by : Jens Hartig Danielsen
The European Union‘s common agricultural policy is without question the most economically significant policy area in EU law, as well as the area in which Union regulation has been implemented most consistently and intensely. This book contends that today, considering this comprehensive regulation of issues that are of prime economic importance – and the rich case law that this EU policy has generated – EU agricultural law cannot be treated as an isolated discipline, but must be seen in the context of general Union law. The author first deeply explores in an unprecedented way what is meant by the expressions ‘agriculture’, ‘agricultural activity’, and ‘agricultural producer’ found in current EU legislation, and goes on to provide a detailed legal analysis in contexts from Member States to the World Trade Organization. In the course of the presentation he examines the following, among much else: the principle of unified markets or common prices; structural funds for promoting regional agricultural development; encouragement of local strategies based on partnership and experience-sharing networks; environmentally friendly agricultural measures; the European Agricultural Guarantee Fund (EAGF) and the European Agricultural Fund for Rural Development (EAFRD); whether a person or undertaking produces agricultural products or processes them; food safety measures; animal welfare; agricultural training and research; ensuring a fair standard of living for the agricultural community; interventions concerning storage or production limitation; State aid schemes; marketing standards; geographical indications; trade with third countries; support for improving the environment and the countryside; payment of aid pursuant to the single payment scheme; and WTO rules on domestic support measures, import duties and restrictions, and exports. As a full-length, in-depth analysis of EU agricultural law, this book has no peers. It is sure to be welcomed not only by legal academics, but by all who are professionally engaged in dealing with issues of Union agricultural law, whether lawyers, professional interest groups, or administrative authorities.

Synopsis The Common Agricultural Policy by : Wyn Grant
This book offers a comprehensive analysis of the Common Agricultural Policy which imposes high costs on taxpayers and consumers yet has proved very difficult to reform. Particular emphasis is placed on new developments affecting the shape of the CAP, including the outcome of the GATT Uruguay Round negotiations, Eastern enlargement, and developments in environmental policy. A distinctive feature of the book is the attention given to situating European agriculture within its global context and in relation to the food processing and agricultural supply industries.

Synopsis EU Law for UK Lawyers by : Aidan O'Neill
This is the second edition of this wide-ranging survey of EU law. The new edition has been significantly enlarged. Unlike many other EU law books it takes full account not only of the Lisbon Treaty changes to the EU treaties, but also of the fact that the EU Charter of Fundamental Rights now has the same legal value as the EU Treaties. It therefore not only covers the relevant case law of the Court of Justice of the European Union, but also ties that case law into the decisions of the European Court of Human Rights, because it is clear that EU law can only now properly be understood and applied against this background of European fundamental rights jurisprudence. The book sets out very clearly the broad shape of the European Union's legal systems, while also giving the reader a good feel for the policy motivations in the Court of Justice of the European Union and the scope of EU legislative activity. Written in a lively and accessible style, it is an ideal guide for practitioners, whether those coming to the subject for the first time or those already with a background in EU law. Among the additions and changes in this expanded edition the book includes new chapters on the EU and fundamental rights, on commercial agency, on criminal law and on private international law in the EU. It also contains a full treatment of EU equality law. The first edition 'EC Law for UK Lawyers' by Aidan O'Neill and Jason Coppel (ISBN: 9780406024596) was published by Butterworths in 1994.

Synopsis The Agricultural Law of the EU by : René Barents
European Monographs Series, Volume 9 This second and much-revised edition of the pre-eminent work on European Union (EU) agricultural law emphasises the sweeping changes that have led to the gradual expansion of the common agricultural policy to encompass the food chain as a whole. Although the new edition’s purpose and methodology remain the same, the author presents a completely new overview of the field as it now exists, including the effects of the latest reform measures up to 2021 and their implications for the future. Imparting in-depth awareness of the multifunctional character of agriculture today – its importance for environmental protection, preservation of biodiversity, public health, mitigation of climate change, and rural development, as well as its international obligations – the book provides matchless insight and clarifications on such critical legal details as the following: analysis of the Green Deal, the Farm to Fork Strategy, and the Biodiversity Strategy for 2030; extensive treatment of the TFEU provisions on agriculture and the impact of international legal instruments; clear and easily accessible treatment of the legislation on market and price policy, competition, and the agri-food chain; thorough analysis of administrative law aspects, in particular, the rights and obligations of operators in the framework of numerous subsidy arrangements and related topics such as sanctions and force majeure; and in-depth treatment of the importance of the general principles of EU law for legal protection. Given that about one-third of the EU’s budget is spent on agriculture – and that European legislation on agriculture is voluminous and complicated and case law is abundant – this well-organised and lucid exposition will be of immeasurable value to any practitioner asked to deal with a case involving agriculture anywhere in the EU. Academics aware of the growing intricacy of the field will welcome the author’s reflections on the meaning and significance of EU agricultural law.

Synopsis Nature and Agriculture in the European Union by : Floor Brouwer
Nature and agriculture both shape the European countryside and one of the main challenges for the years to come will be to strengthen their interaction for the future development of rural areas. In this valuable and highly topical book, the authors demonstrate how economics and ecology can play a critical role in maintaining and sustaining this relationship. The book identifies the dilemmas facing European agriculture and explores their economic and ecological consequences. The authors believe a better understanding of these problems will be crucial in recognising the potential options for the future role of agriculture and nature policy and will guide the identification of suitable policy instruments. They highlight current threats to the relationship between agriculture and nature - such as abandonment and intensification - and demonstrate how these problems can be resolved by a rational policy mix. The book also provides extensive empirical evidence from four case studies and concludes by scrutinising the major changes in market conditions and the Common Agricultural Policy which could upset this important but fragile balance between agriculture and nature.

Synopsis Food and Agriculture in Bulgaria by : Csaba Csáki
Agriculture traditionally played a significant role in the Bulgarian economy. Before the present decade, Bulgaria was a major exporter of fresh and processed fruits and vegetables within Eastern and Central Europe. While the Bulgarian government has progressed rapidly since 1997, the delay in reforms has rendered Bulgarian food products as noncompetitive on the international market. Also, many important components of the transition are not completed. This report reviews the recent history and current state of Bulgarian agriculture and agroindustry. It examines the status of the sectoral reforms program, including reforms affecting pricing and trade, rural finance, land markets, and agroindustry, with emphasis on evaluating its progress toward meeting the criteria for EU accession. It highlights the tremendous advances made recently, and also suggests an agenda for prioritizing the remaining obstacles. This report is intended for agricultural scientists, public officials, politicians, agricultural and agroindustrial leaders, economic researchers and others interested in the transformation of agriculture in the transition economies and in issues pertaining to accession of Central and East European candidate countries to the European Union.
