The experi ence of the author, both as a student and as an instructor in this branch of the law, has led him to believe that students of the law generally look upon the law of Real Property as extremely technical, arbitrary and unreasonable. Believ ing that all law is founded upon reason, and is developed by forces, which are not produced or even controlled by the arbitrary will of the legislator, and feeling confident that a logical or historical reason could be found for every principle of the law of Real Property, the author has made that subject the object of his special study, and this volume is given to the profession as the result of his investigations, with the hope that it might aid in stripping this branch of the law of its harsh and uninviting dress.
