In December 2008 some 350 Chinese intellectuals published a manifesto calling for reform of the Chinese constitution and an end to one-party rule. Known as "Charter 08," the manifesto has since been signed by more than 10,000 people. One of its authors, Liu Xiaobo, was awarded the Nobel Peace Prize in 2010 but has remained in prison since 2009 for subversive crimes. This collection of essays—the first of its kind in English—examines the trial of Liu Xiaobo, the significance and impact of Charter 08, and the prospects for reform in China. The essays include contributions from legal and political experts from around the world, an account of Liu's trial by his defence lawyers, and a passionate—and ultimately optimistic—account of resistance, repression and political change by the human rights lawyer Teng Biao.

Following significant interethnic violence beginning in 2008, Chinese intellectuals and policymakers are now engaged in unprecedented debate over the future direction of their country's ethnic policies. This study attempts to gauge current Chinese opinion on this once-secretive and still highly sensitive area of national policy. Domestic Chinese opinion on ethnic policies over the last five years is reviewed and implications for future policies under the new leadership of CPC Secretary General Xi Jinping are explored. Careful review of a wide spectrum of contemporary Chinese commentary identifies an emerging consensus for ethnic-policy reform. Leading public intellectuals, as well as some party officials, now openly call for new measures strengthening national integration at the expense of minority rights and autonomy. These reformers argue that divisive ethnic policies adopted from the former USSR must be replaced by those supporting an ethnic "melting pot" concept. Despite this important shift in opinion, such radical policy changes as ending regional ethnic autonomy or minority preferences are unlikely over the short-to-medium term. Small-yet-significant adjustments in rhetoric and policy emphasis are, however, expected as the party-state attempts to strengthen interethnic cohesiveness as a part of its larger agenda of stability maintenance. When the Nobel Peace Prize was awarded on December 10, 2010, its recipient, Liu Xiaobo, was in Jinzhou Prison, serving an eleven-year sentence for what Beijing called “incitement to subvert state power.” In Oslo, actress Liv Ullmann read a long statement the activist had prepared for his 2009 trial. It read in part: “I stand by the convictions I expressed in my ‘June Second Hunger Strike Declaration’ twenty years ago—I have no enemies and no hatred. The core idea shared by all cosmopolitan views is that all human beings belong to a single community and the ultimate units of moral concern are individual human beings, not states or particular forms of human associations. Nevertheless, the attempts to ground a political theory on overarching universal principles is in contradiction with the plurality of social, cultural, political, religious interpretative standpoints in the contemporary world. Is dissent cosmopolitan? Is there a legacy of dissent for a theory of cosmopolitanism? This book is a comparative, historical analysis of dissident thought and practice for contemporary debates on cosmopolitanism. Divided into two parts, the editors and contributors explore the contribution of ‘paradigmatic’ dissidents like Gandhi, Martin Luther King, Havel, Sakharov, Mandela, Liu Xiaobo, Aung San Suu Kyi towards a post-universalist cosmopolitan theory. Part Two examines the inherent cosmopolitanism of the seemingly ‘peripheral’ dissent of contemporary forms of protests, resistance, direct action like NO TAV movement and Occupy Wall Street. A timely book which allows for a much needed new engagement in contemporary debates of cosmopolitanism, we learn how practical resistance to totalizing/hegemonic claims is generated, and how dissident thinking might contribute to new, enriched ways of conceiving the non-totalizing foundations of cosmopolitanism. An innovative look at what lessons can scholars of cosmopolitanism learn from dissent/dissident movements, and what the role of dissent in cosmopolitan democracy could be.

This book studies ideological divisions within Chinese legal academia and their relationship to arguments about the rule of law. The book describes argumentative strategies used by Chinese legal scholars to legitimize and subvert China's state-sanctioned ideology. It also examines Chinese efforts to invent new, alternative rule of law conceptions. In addition to this descriptive project, the book advances a more general argument about the rule of law phenomenon, insisting that many arguments about the rule of law are better understood in terms of their intended and actual effects rather than as analytic propositions or descriptive statements. To illustrate this argument, the book demonstrates that various paradoxical, contradictory and otherwise implausible arguments about the rule of law play an important role in Chinese debates about the rule of law. Paradoxical statements about the rule of law, in particular, can be useful for an ideological project.
