1.1 An Introduction to IS‘‘adoption’’ The term "IS ‘adoption’’" has been used by the researcher because, in international law, all countries are referred to as "States." International context of ‘adoption’’, also known as IS‘‘ adoption’’, is a subject of private international law that involves four parties: (i) the kid who is the subject of IS‘‘adoption’’, (ii) the person who took the kid in ‘‘adoption’’, (iii) both of whom are from a different country, (iv) the giving state who provides their kids for ‘‘adoption’’, and the receiving state. In such set of circumstances, a person makes final decision to adopt a kid. In this IS ‘adoption’’ procedure, the interests of the kid take precedence above all other considerations. However, we cannot ignore the national interest.

This examination of the role played by the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) in advancing indigenous peoples' self-determination comes at a time when the quintessential Eurocentric nature of international law has been significantly challenged by the increasing participation of indigenous peoples on the international legal scene. Even though the language of human rights discourse has historically contributed to delegitimise indigenous peoples' rights to their lands and cultures, this same language is now upheld by indigenous peoples in their ongoing struggles against the assimilation and eradication of their cultures. By demanding that the human rights and freedoms contained in various UN human rights instruments be now extended to indigenous peoples and communities, indigenous peoples are playing a key role in making international law more 'humanising' and less subject to State priorities.

This book continues the themes addressed by its two predecessors in this mini-series by examining the role of the principle of the welfare interests of the child in the law of the U.S. and Canada. It provides a record of the key milestones in its development in each country and conducts a comparative analysis of the contemporary law relating to children in both.
