Aquaculture, the farming in water of aquatic animals and aquatic plants, has seen extraordinary growth over recent years in terms of production levels and as regards its share of production of aquatic animals and algae. Although the most recent figures show a slight slowdown in the rate of growth of the sector (FAO, 2022), aquaculture is still seen to have tremendous potential. Many developing countries have high aspirations for rapid aquaculture development in order to feed their fast-growing populations and to increase export earnings. The aim of this study is to identify the essential elements of a legal framework for sustainable aquaculture. For the fact is that in many countries the growth of aquaculture appears to have outpaced the development of the legislation and legal frameworks to govern aquaculture. This study is intended both to act as a guide to the complexity of legal frameworks for aquaculture and also to serve as the background or resource document for the Aquaculture Legal Assessment and Revision Tool (ALART).

The decade between the Rio Conference and the recently completed World Summit on Sustainable Development in Johannesburg was a period of intense activity in the reform of national and international laws. This publication reports and reflects on the changes that have taken place and on emerging trends and interesting experiments in the legal frameworks governing agriculture and natural resource management. Individual chapters address legal trends in the subjects that are at the center of the sustainable development agenda, including: food, animals, plants, agrobiodiversity, water, fisheries, land, gender, forestry, wildlife and mountains.

With aquaculture operations fast expanding around the world, the adequacy of aquaculture-related laws and policies has become a hot topic. This much-needed book provides a three-part guide to the complex regulatory landscape. The expert contributors first review the international legal dimensions, including chapters on law of the sea, trade, and access and benefit sharing. Part Two offers regional perspectives, discussing the EU and regional fisheries management organizations. The final part contains eleven case studies exploring how leading aquaculture producing countries have been putting sustainability principles into practice.

This study considers the elements of a legal framework designed to promote a sustainable commercial aquaculture. These relate to: a secure right to property and clean water; avoidance of unnecessary costs; and a licence system, including a system for environmental impact assessments and enforcement of codes of practice. Environmental supervision should extend to: controls over the use of exotic species and products from modern biotechnology. These include genetically modified organisms, disease control and health management, and to any water quality concerns created by the proposed project. The study analyses the aquaculture industries of Madagascar, Malawi, Mozambique, Nigeria and Zambia against these criteria. Improvements in legislation applicable to the individual countries, but which require consideration by all sub-Saharan countries are then suggested.

While the aquaculture sector has seen extraordinary global growth over recent years, it also faces a number of important challenges. Although aquaculture may reduce pressure on wild fish stocks, the fact remains that the sector can also have a range of negative environmental impacts. At the same time, a degraded environment, in particular poor water quality, can adversely affect the health of aquatic animals and plants used in aquaculture and therefore the economic sustainability of the sector. Moreover, if appropriate bio-security measures, in the sense of measures to protect aquatic animal health, aquatic plant health and human health, are not in place (or are not implemented), the sector can be subject to devastating disease outbreaks. It follows that the legal framework for aquaculture should support the development of the sector while at the same time promoting its long term environmental, social and economic sustainability. This requires a balancing act. Overly burdensome legislation may discourage or otherwise hinder investment. At the same time, insufficient regulation may encourage indiscriminate and substandard operations that lead to uncontrollable disease outbreaks, irreparable environmental damage and the economic failure of aquaculture operations with ensuing social costs. Unlike capture fishing, which is regulated largely if not exclusively on the basis of a fisheries law, the legal framework for aquaculture is invariably diverse and complex. Some aspects of aquaculture are addressed in legislation that has aquaculture as its specific or primary focus, such as a chapter in a fisheries law or a stand-alone aquaculture law (described in this document as ‘aquaculture legislation’).

Part 3 covers the high-impact challenges and opportunities of the untapped potential of utilizing whole fish and by-products to improve food security and nutrition, expounds on the role of aquatic food systems in providing critical climate, biodiversity and environmentally sound solutions, and highlights the importance of their integration into national and multilateral processes. It also presents an outlook on future trends up to 2032 based on projections. The State of World Fisheries and Aquaculture 2024 provides the most up-to-date and evidence-based information, supporting policy, scientific and technical insights on challenges, opportunities and innovations shaping the present and future of the sector, for the benefit of a wide and expanding audience of policymakers, managers, scientists, fishers, farmers, traders, civil society activists and consumers.

The Codex Alimentarius, “the food code”, has a fundamental role in protecting consumers all around the world and ensuring fair practices in food trade. The Code of Practice for Fish and Fishery Products is the essential reference point for technical guidance on the harvesting, processing, transport and sale of fish and fishery products.

In June 2014, FAO member-states endorsed the Voluntary Guidelines for Securing Sustainable Small-Scale Fisheries (SSF Guidelines). These Guidelines are one of the most significant landmarks for small-scale fisheries around the world. They are comprehensive in terms of topics covered, and progressive, with their foundations based on human rights and other key principles. It can be anticipated that implementing the SSF Guidelines, whether at local, national, or regional levels, will be challenging. This book contains in-depth case studies where authors discuss the extent to which the Guidelines can help improve the realities of small-scale fishing men and women globally and make their livelihoods and communities more secure. This will require policy intervention and innovation, along with contributions of civil society organizations and academia. However, most of all it will necessitate the empowerment of fishing people so that they can become active participants in decision making on matters where their well-being and human rights are at stake. By endorsing the SSF Guidelines, states have committed themselves to support and facilitate this development. This book asks whether states can successfully “walk the talk,” and provides advice as to how they can do so. The collection of case studies sets the platform for an interactive dialogue space for researchers, policy makers, civil society and small-scale fishing communities to start the conversation about the monitoring and evaluation of the implementation of the SSF Guidelines at local, national, regional and global levels.
