Synopsis Understanding and Profiting from Intellectual Property in International Business by : Deli Yang

This book covers cross-border strategies to understand and profit from intellectual property. It starts with a basic overview of IP before focusing specifically on international business contexts. The book then explores factors that affect IP-related business activities in different countries. Next, follows a discussion of the importance of managing IP valuation, people, and products, which leads into an examination of strategies for obtaining value from IP-related activities, including licensing. This edition updates the contents and adds new contemporary cases, such as internet-based crimes and trademarked sport brands. Readers will gain an understanding of the significance of IP to corporate success in the increasingly globalized world. With updated knowledge on deriving value from IP, this book will provide insights for practitioners to deal with cross-border issues of IP, and for scholars across disciplines to advance studies of cross-border issues and conflicts in IP.

Synopsis Intellectual Property Theory and Practice by : Wenwei Guan

This book explains China’s intellectual property perspective in the context of European theories, through a critical examination of intellectual property theory and practice focused on China’s compliance with the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). The author’s critical review of contemporary intellectual property philosophy suggests that justifying intellectual property protection through Locke or Hegel’s property theories internalizes a theoretical paradox. “Professor Wenwei Guan’s treatment of intellectual property law and practice in the PRC offers new perspectives that enrich an already active field of study . . . This book will be a useful contribution to academic and policy discourses examining conceptual and operational dimensions of China’s intellectual property protection system and the broader process of China’s international engagement.” – Dr. Pitman B. Potter, Professor of Law, University of British Columbia, Canada “Dr. Guan reminds us of the daunting challenge of the public-private divide in forming and reforming TRIPS regime; how this regime has failed to address development needs and public concerns in developing countries like China; and how TRIPS’s ‘birth defect’ can be overcome and its evolution can be put back on the right track.” – Dr. Yahong Li, Associate Professor at Faculty of Law, Hong Kong University

Synopsis The Real Culture War by : Gerard Michael Emershaw

In his book Culture Warrior, Bill O'Reilly--the host of the Fox News Channel show "The O'Reilly Factor"--incorrectly characterizes the Culture War as a social, political, and intellectual struggle between "traditionalists" and "secular-progressives." THE REAL CULTURE WAR analyzes, dissects, and discredits Bill O'Reilly's conception of the Culture War and argues that he gets it all wrong. His "traditionalism" and "secular-progressivism" are merely two heads of the same collectivist beast. THE REAL CULTURE WAR pits Individualism versus Collectivism. Individualism states that human beings have intrinsic value and possess the natural rights to life, liberty, and property. This view was held by the Founding Fathers. Collectivism states that human beings only have value in virtue of their relationship to the collective. This view was held by the "Philosopher-Kings" (PKs)--tyrannical leaders who view themselves as enlightened and exempt themselves from the draconian laws they force upon others. PKs discussed in THE REAL CULTURE WAR include Mussolini, Hitler, Stalin, and Mao as well as American leaders Theodore Roosevelt, Woodrow Wilson, Herbert Hoover, Franklin D. Roosevelt, Al Gore, George W. Bush, and Barack Obama. The intellectual, historical, and empirical foundations of Individualism and Collectivism are examined, and it is argued that logic and reason establish that Individualism is the superior worldview because Individualism naturally leads to peace, prosperity, and freedom whereas Collectivism invariably leads to war, poverty, and tyranny. Specific formulations of Collectivism--Communism, Fascism/Nazism, Progressivism, Environmentalism, Neoconservatism, Racism, Religionism, Corporatism, and Labor Unionism--are fully exposed and critiqued. Next, an alternate conception of government in the form of the Individualist State is developed and defended while building the "Night-Watchman State" from first principles. Within this "Minarchist State" is a system of taxation which provides a justifiable connection between the tax paid by the people in order to maintain the State whose duty it is to defend the natural rights of the people. These natural rights--life, liberty, and property--are each examined in depth and controversial issues related to them are analyzed fully in order to present philosophically sound solutions. Additionally, the structure and functions of the three branches of government--Executive, Legislative, and Judicial--of the Individualist State are explained, and it is demonstrated that the form of government written into the Constitution is a "Night-Watchman State" similar to the Individualist State. Later, modern threats to Individualism--the economic tyranny of the Federal Reserve, the globalism of the New World Order, and the collectivist Neo-Progressivism of President Barack Obama--within the United States are described in detail. Finally, a five-step plan of action is revealed for what individualists can do to win the Real Culture War.

Synopsis Human Rights by : Laura Westra

International law has evolved to protect human rights. But what are human rights? Does the term have the same meaning in a world being transformed by climate change and globalized trade? Are existing laws sufficient to ensure humanity’s survival? Drawing on case law and practice and examples from philosophy, law, and ecology, Laura Westra argues that the current system is not adequate: international law privileges individual over collective rights, permitting multinational corporations to overlook the collectivity and the environment in their quest for wealth and power. Unless policy makers redefine human rights and reformulate environmental law and policies to protect the preconditions for life itself -- water, food, clean air, and biodiversity -- humankind faces the complete loss of the ecological commons, the preservation of which is one of our most basic human rights. A new kind of cosmopolitanism, one centred on the United Nations, offers the best hope for preserving our common heritage and the survival of future generations.
