The intertwining of development and human rights is the subject of the twelve essays collected by the editors. The individual authors extensively examine the commonly held belief that economic development cannot take place in Third World countries without the short term sacrifice of political liberty and demonstrate that there is considerable evidence to the contrary. Following a theoretical stage-setting that concentrates on the severe power limitations and the dependency of weak Third World states, case studies focus on such issues as state terrorism, food, the right to modernize, refugees, and support of apartheid in Latin America, the People's Republic of China, the Middle East, and Africa. Several essays concern the implementation of human rights and the role of multinational corporations and international nongovernmental organizations in protecting them. The final essay considers the international framework of government, law, and organization as a means for implementing human rights development in the Third World.

Populations for the sins of their rulers.

This book is devoted to the 25th anniversary of the United Nations Declaration on the Right to Development. It contains a collection of analytical studies of various aspects of the right to development, which include the rule of law and good governance, aid, trade, debt, technology transfer, intellectual property, access to medicines and climate change in the context of an enabling environment at the local, regional and international levels. It also explores the issues of poverty, women and indigenous peoples within the theme of social justice and equity. The book considers the strides that have been made over the years in measuring progress in implementing the right to development and possible ways forward to make the right to development a reality for all in an increasingly fragile, interdependent and ever-changing world.

The chapters in this volume are based on the papers that were presented at the Calcutta seminar organized in March 1992 by the ILA Committee on Lehal Aspects of a New International Economic Order (NIEO). The conference focused on the right to development, in particular its ideas and ideology, human rights aspects and implementation in specific areas of international law. The volume is accordingly organized in three parts. The chapters cover a vast area of subjects, derived from the UN Declaration of the Right to Development. From the developed and underdeveloped world 33 authors discuss topics including: contents, scope and implementation of the right to development; human rights of individuals and peoples; co-operation between the European Community and the Lomé IV states; current developments in investments treaties; refugee protection; development and democracy; concept of sustainable development; environmental issues; protection of intellectual property; transfer of technology; human rights in international financial institutions; and the legal conceptualization of the debt crisis. Professor Oscar Schachter observes in the first chapter that the Declaration continues to be a `challenging subject for legal commentary' for its `detable legal status, its combination of collective and individual rights, its expansive conception of development and its equivocal obligation'. Apart from support, doubts about the concept to the right to development may also be found in this volume.

This text considers the issues of world poverty and global justice, addressing the ability of people in poor or developing countries to have enough food, or clean water, or access to basic healthcare. It draws on international law aimed at the protection and promotion of human rights.

This report revisits the theoretical concepts of inequalities including their measurements, analyzes their global trends, presents the policy makers' perception of inequalities in 15 countries and identifies various policy options in combating this major development challenge of our time. The report makes the basic point that in spite of the impressive progress humanity has made on many fronts over the decades, it still remains deeply divided. In that context, it is intended to help development actors, citizens, and policy makers contribute to global dialogues and initiate conversations in their own countries about the drivers and extent of inequalities, their impact, and the ways in which they can be curbed.

Why are carefully designed, sensible policies too often not adopted or implemented? When they are, why do they often fail to generate development outcomes such as security, growth, and equity? And why do some bad policies endure? World Development Report 2017: Governance and the Law addresses these fundamental questions, which are at the heart of development. Policy making and policy implementation do not occur in a vacuum. Rather, they take place in complex political and social settings, in which individuals and groups with unequal power interact within changing rules as they pursue conflicting interests. The process of these interactions is what this Report calls governance, and the space in which these interactions take place, the policy arena. The capacity of actors to commit and their willingness to cooperate and coordinate to achieve socially desirable goals are what matter for effectiveness. However, who bargains, who is excluded, and what barriers block entry to the policy arena determine the selection and implementation of policies and, consequently, their impact on development outcomes. Exclusion, capture, and clientelism are manifestations of power asymmetries that lead to failures to achieve security, growth, and equity. The distribution of power in society is partly determined by history. Yet, there is room for positive change. This Report reveals that governance can mitigate, even overcome, power asymmetries to bring about more effective policy interventions that achieve sustainable improvements in security, growth, and equity. This happens by shifting the incentives of those with power, reshaping their preferences in favor of good outcomes, and taking into account the interests of previously excluded participants. These changes can come about through bargains among elites and greater citizen engagement, as well as by international actors supporting rules that strengthen coalitions for reform.

Some 2.5 billion human beings live in severe poverty, deprived of such essentials as adequate nutrition, safe drinking water, basic sanitation, adequate shelter, literacy, and basic health care. One third of all human deaths are from poverty-related causes: 18 million annually, including over 10 million children under five. However huge in human terms, the world poverty problem is tiny economically. Just 1 percent of the national incomes of the high-income countries would suffice to end severe poverty worldwide. Yet, these countries, unwilling to bear an opportunity cost of this magnitude, continue to impose a grievously unjust global institutional order that foreseeably and avoidably perpetuates the catastrophe. Most citizens of affluent countries believe that we are doing nothing wrong. Thomas Pogge seeks to explain how this belief is sustained. He analyses how our moral and economic theorizing and our global economic order have adapted to make us appear disconnected from massive poverty abroad. Dispelling the illusion, he also offers a modest, widely sharable standard of global economic justice and makes detailed, realistic proposals toward fulfilling it. Thoroughly updated, the second edition of this classic book incorporates responses to critics and a new chapter introducing Pogge's current work on pharmaceutical patent reform.

Even in impoverished countries lacking material and human resources, P. T. Bauer argues, economic growth is possible under the right conditions. These include a certain amount of thrift and enterprise among the people, social mores and traditions which sustain them, and a firm but limited government which permits market forces to work. Challenging many views about development that are widely held, Bauer takes on squarely the notion that egalitarianism is an appropriate goal. He goes on to argue that the population explosion of less-developed countries has on the whole been a voluntary phenomenon and that each new generation has lived better than its forebears. He also critically examines the notion that the policies and practices of Western nations have been responsible for third world poverty. In a major chapter, he reviews the rationalizations for foreign aid and finds them weak; while in another he shows that powerful political clienteles have developed in the Western nations supporting the foreign aid process and probably benefiting more from it than the alleged recipients. Another chapter explores the link between the issue of Special Drawing Rights by the International Monetary Fund on the one hand and the aid process on the other. Throughout the book, Bauer carefully examines the evidence and the light it throws on the propositions of development. Although the results of his analysis contradict the conventional wisdom of development economics, anyone who is seriously concerned with the subject must take them into account.

This theoretical and practical overview of the international legal architecture between developing countries and advanced nations is divided into two parts, the first providing a theoretical overview of the philosophical implications of international development law principles; the second deals with international financial architecture.
