The fight against the sexual exploitation of and trade in children has gained particular and renewed international attention in the last few years and has become one of the most important concerns in the context of international law enforcement policy and cooperation. Since 1998, policy makers have come up with new legal initiatives at global as well as regional levels in order to tackle this problem in a more effective and coordinated way. This proves that the time has come to match words and actions, and to come up with concrete and useful tools for law enforcement services and NGO's active in the areas concerned. The current study therefore examines the feasibility of the further elaboration and implementation of recommendations from a previous project (96/STOP/003) regarding the systematic gathering and administration of data concerning missing minors, minor victims of trafficking in or sexual exploitation of children and perpetrators of sexual offences against minors, with the goal to further prepare the practical setting up of several international databases with immediate relevance to the police and the prosecuting or investigating magistrates or officials, both in the EU Member States and the candidate countries. It is recommended to give Interpol a mandate to host an international database on missing persons and to create an EU monitoring centre responsible for the gathering and administration of reliable statistics and legal information on sexual exploitation of children and trafficking in human beings. It is also recommended for Interpol to host an international reference database on child pornography and to set up an analysis/intelligence child porn database at Europol. Regarding suspected and convicted sex offenders, it is proposed to create a database on pending investigations, an EU criminal records database and a database at Europol containing encoded information on both suspected and convicted offenders of sexual offences against children. Finally, it is suggested to create a European network of national DNA databases. The book also contains a summary of the conclusions in French.

"Violence against women undermines women's core fundamental rights such as dignity, access to justice and gender equality. For example, one in three women has experienced physical and/or sexual violence since the age of 15; one in five women has experienced stalking; every second woman has been confronted with one or more forms of sexual harassment. What emerges is a picture of extensive abuse that affects many women's lives but is systematically underreported to the authorities. The scale of violence against women is therefore not reflected by official data. This FRA survey is the first of its kind on violence against women across the 28 Member States of the European Union (EU). It is based on interviews with 42,000 women across the EU, who were asked about their experiences of physical, sexual and psychological violence, including incidents of intimate partner violence ('domestic violence'). The survey also included questions on stalking, sexual harassment, and the role played by new technologies in women's experiences of abuse. In addition, it asked about their experiences of violence in childhood. Based on the detailed findings, FRA suggests courses of action in different areas that are touched by violence against women and go beyond the narrow confines of criminal law, ranging from employment and health to the medium of new technologies."--Editor.

In the EU area of freedom, security, and justice, one of the main deficiencies is the lack of cross-country comparable data on crime and criminal justice. The importance of progress in this domain - especially in the context of the identification of best practices in the fight against crime - has been identified on several occasions. The main difficulty lies in the comparability of data or the guarantee that exchanged data is understood in the same way by all actors. In March 2007, the European Commission's Directorate-General for Justice, Freedom and Security launched a call for a Study on the Development of an EU Level Offence Classification System and an Assessment of Its Feasibility to Supporting the Implementation of the Action Plan to Develop an EU Strategy to Measure Crime and Criminal Justice (The Crime Statistics Project [CSP]). This book contains the final report of that Project. In the context of the project, the EU Level Offence Classification System (EULOCS) was created. Its aim is not to become yet another compelling system that requires Member States to further harmonize domestic criminal law or to adjust national data models, but to be a reference index that could serve the different needs in the wider area of justice and home affairs. According to its authors, the area of justice and home affairs could benefit from using EULOCS as a bench-mark, increasing the internal coherence of EU's criminal policy. In the past decades, the European Union has made little progress with respect to disqualifications as a sanction mechanism for the violation of laws. The creation of some form of harmonization is necessary, but the complex nature of this specific sanction mechanism has caused policy initiatives to be postponed, time after time. In answer to a call from the European Commission, the contributors in this book have conducted a comparative legal analysis in the EU 27 and looked into the practical experiences with disqualifications from a domestic and a cross border perspective. To that end, academics, policy makers, and practitioners in the Member States have been consulted. Analysis reveals a wide variety in the typology of the disqualifications as a sanction measure, the typology of the persons to whom the disqualifications can be imposed, and the typology of the authorities involved. Furthermore, there are considerable differences with respect to the inclusion of disqualifications in the national criminal records databases. Linked thereto information on foreign disqualifications is scarce and rarely used in practice. To ensure a comprehensive and consistent policy approach, this book has come up with a so called disqualification triad, comprising: (1) unified EU-wide disqualifications, (2) mutual recognition of disqualifications, and (3) EU-wide equivalent effect of disqualifications. The functioning of the disqualification triad has been further elaborated on in three case studies, which are public procurement disqualifications, disqualifications from working with children, and driving disqualifications. This book presents the conclusions of a study, concerning the legal, politico-institutional and practical feasibility of an EU criminal records database. The November 2000 Mutual Recognition Plan called for such a study in view of the individualisation of sanctions by judges in the member states and the mutual recognition of disqualifications. The purpose is to find the best way the member states' competent authorities can be informed of an individual's criminal convictions. The study developed recommendations concerning the content and the organisation of an EU criminal records database, taking into account requirements of data protection, identification, notification of the persons involved, rehabilitation and translation. Access to the database by member states, EU bodies, third bodies and third states has been clearly defined, as well as access for employees in vulnerable professions. The proposal for an EU criminal records database takes due account of extensive feedback received from the bodies involved in international exchange of criminal records information and key-actors from the EU member states' and candidate member states' competent authorities. In addition, the responses of these states to the research questionnaire were collected and included. Undoubtedly, this book will be an asset to everyone who is interested in the exchange of information between the EU member states and bodies in criminal matters.

With an emphasis on respecting the rights of children and keeping their best interests in the forefront, the convention covers preventive measures; criminal offences, including several entirely new offences, such as "child grooming"; protective measures and assistance to child victims and their families; "child-friendly" procedures for investigation and prosecution which are adapted to children's special needs; intervention programmes or measures for child sex offenders; recording and storing of data on convicted sex offenders; international co-operation and a monitoring mechanism.
