Synopsis Dividing Western Waters by : Jack L. August
The Scopes Monkey Trial, the Sacco and Vanzetti case, Brown v the Board of Education, and even subsequent televised high profile murder trials pale in comparison to Arizona v California, argues author Jack August in Dividing Western Waters, August’s look at Arizona’s Herculean legal and political battle for an equitable share of the Colorado River. To this day Arizona v California is still influential. By the time Mark Wilmer settled in the Salt River Valley in the early 1930s, he realized that four basic commodities made possible civilization in the arid West: land, air, sunshine, and water. For Arizona, the seminal water case, Arizona v California, the longest Supreme Court case in American history (1952–1963), constituted an important step in the construction of the Central Arizona Project (CAP), a plan crucial for the development of Arizona’s economic livelihood. The unique qualities of water framed Wilmer’s role in the history of the arid Southwest and defined his towering professional career. Wilmer’s analysis of the Supreme Court case caused him to change legal tactics and, in so doing, he changed the course of the history of the American West.

Synopsis Unsettled Waters by : Eric P. Perramond
In the American West, water adjudication lawsuits are adversarial, expensive, and lengthy. Unsettled Waters is the first detailed study of water adjudications in New Mexico. The state envisioned adjudication as a straightforward accounting of water rights as private property. However, adjudication resurfaced tensions and created conflicts among water sovereigns at multiple scales. Based on more than ten years of fieldwork, this book tells a fascinating story of resistance involving communal water cultures, Native rights and cleaved identities, clashing experts, and unintended outcomes. Whether the state can alter adjudications to meet the water demands in the twenty-first century will have serious consequences.

Synopsis The Evolution of the Law and Politics of Water by : Joseph W. Dellapenna
According to a famous Talmudic story (Babylonian Talmud, Tractate Shabbat: 31a), a gentile once approached Rabbi Hillel and asked to be taught the entire Torah while standing on one foot. Hillel replied, ‘Love your neighbour as yourself. That is the entire Torah. The rest is simply an explanation. Go and learn it!’ In much the same way, Jewish law can be described in one word—Torah. All the rest is simply an explanation. The Torah, also known as the Bible, the five books of Moses, and the Pentateuch, was written over 3,000 years ago. Since then, Jewish law has developed various interpretations and applications of the Torah, interpretations of those interpre- tions, and so on. Jewish law contains civil dictates as well as religious protocol. Problems that arose in the framework of religious life and problems surrounding civil relationships both found solutions in the same legal source—the Torah and the Halacha, the Jewish legal interpretations and rulings. This chapter on water law in the Jewish tradition provides insight into Jewish law and custom in general, and rules related to the protection of water sources in particular. One should not look, however, to find a written code of Jewish law, as there is none.

Synopsis Contested Waters by : April R. Summitt
"To fully understand this river and its past, one must examine many separate pieces of history scattered throughout two nations--seven states within the United States and two within Mexico--and sort through a large amount of scientific data. One needs to be part hydrologist, geologist, economist, sociologist, anthropologist, and historian to fully understand the entire story. Despite this river's narrow size and meager flow, its tale is very large indeed." -From the conclusion The Colorado River is a vital resource to urban and agricultural communities across the Southwest, providing water to 30 million people. Contested Waters tells the river's story-a story of conquest, control, division, and depletion. Beginning in prehistory and continuing into the present day, Contested Waters focuses on three important and often overlooked aspects of the river's use: the role of western water law in its over-allocation, the complexity of power relationships surrounding the river, and the concept of sustainable use and how it has been either ignored or applied in recent times. It is organized in two parts, the first addresses the chronological history of the river and long-term issues, while the second examines in more detail four specific topics: metropolitan perceptions, American Indian water rights, US-Mexico relations over the river, and water marketing issues. Creating a complete picture of the evolution of this crucial yet over-utilized resource, this comprehensive summary will fascinate anyone interested in the Colorado River or the environmental history of the Southwest.

Synopsis Civil War Biographies from the Western Waters by : Myron J. Smith, Jr.
From 1861 to 1865, the Civil War raged along the great rivers of the Ohio and Mississippi valleys. While various Civil War biographies exist, none have been devoted exclusively to participants in the Western river war as waged down the Mississippi to the mouth of the Red River, and up the Ohio, the Tennessee and the Cumberland. Based on the Official Records, county histories, newspapers and internet sources, this is the first work to profile personnel involved in the fighting on these great streams. Included in this biographical encyclopedia are Union and Confederate naval officers down to the rank of mate; enlisted sailors who won the Medal of Honor, or otherwise distinguished themselves or who wrote accounts of life on the gunboats; army officers and leaders who played a direct role in combat along Western waters; political officials who influenced river operations; civilian steamboat captains and pilots who participated in wartime logistics; and civilian contractors directly involved, including shipbuilders, dam builders, naval constructors and munitions experts. Each of the biographies includes (where known) birth, death and residence data; unit organization or ship; involvement in the river war; pre- and post-war careers; and source documentation. Hundreds of individuals are given their first historic recognition.

Synopsis Water Rights and the Environment in the United States by : John R. Burch Jr.
This sweeping study traces the development of water policy in the United States from the 19th century to the present day, exploring the role of legislation in appropriating access to water to the American people. Three factors influence the development of water policy and politics in the United States: the availability of water, the manner in which people use the commodity to its maximum economic benefit, and governmental control. This book is a one-stop resource for understanding the scope of water issues in America, from governing doctrine and legislation, to Native American water rights, to water protection and pollution, and to the mitigation of natural and manmade disasters. Distinguished author and noted scholar John R. Burch Jr. reviews the conflicts among state, federal, and international agencies in dealing with water supply and points to competing legal rulings and laws as undermining the creation of a cohesive policy for all. Through an analysis of key documents, Burch examines the recent calamities befalling the American water system—including droughts, oil spills, and natural disasters—and considers the future of water distribution to the American people. Organized into six parts, sections include doctrines and rights, waters of the West, border regions water management and flood control, environmental issues, and water supply and safety.
