Piracy is a significant global threat to international sea-borne trade - the life-blood of modern industrial economies and vital for world economic survival. The pirates of today are constantly in the world's news media, preying on private and merchant shipping from small, high-speed vessels. Andrew Palmer here provides the historical background to the new piracy, its impact on the shipping and insurance industries and also considers the role of international bodies like the UN and the International Maritime Bureau, international law and the development of advanced naval and military measures. He shows how this 'new' piracy is rooted in the geopolitics and socio-economic conditions of the late-20th century where populations live on the margins and where weak or 'failed states' can encourage criminal activity and even international terrorism. Somalia is considered to be the nest of piracy, but hotspots include not only the Red Sea region, but also the whole Indian Ocean, West Africa, Latin America, Southeast Asia and the South China Seas.

Recent attacks, including those on U.S.-flagged vessels, in the waters off the Horn of Africa have brought new U.S. and international attention to the long-standing problem of piracy in the region. The increase in pirate attacks off the Horn of Africa is directly linked to continuing insecurity and the absence of the rule of law in war-torn Somalia. The absence of a functioning government in Somalia remains the single greatest challenge to regional security and provides freedom of action for those engaged in piracy along the Somali coast. Some observers also have alleged that the absence of coastal security authorities in Somalia has allowed illegal international fishing and maritime dumping to occur in Somali waters, which in turn has undermined the economic prospects of some Somalis and may be providing economic or political motivation to some groups engaged in piracy. The apparent motive of many active Somali pirate groups is profit, and piracy has proven to be a lucrative activity for many thus far. Most experts believe that the reestablishment of government authority in Somalia is the only guarantee that piracy will not persist or reemerge as a threat. Congress may seek to influence U.S. policy through oversight of U.S. military operations and diplomacy and through foreign assistance appropriations and authorizations.

This volume provides a concise introduction to the issues and debates regarding modern piracy, including naval operations, law, and diplomacy, and focuses on the recent surge of attacks off the coasts of Africa and Asia. In the past decade, the incidence of maritime piracy has exploded. The first three months of 2011 were the worst ever, with 18 ships hijacked, 344 crew taken hostage, and 7 crew members murdered. The four Americans on board the sailing vessel Quest were shot at point-blank range. The economic costs are also staggering, reaching $7 to $12 billion per year, as insurance costs skyrocket, ransoms double and then quadruple, and ships are forced to hire armed security for protection. Pirates operating off the Horn of Africa disrupt shipping traffic through the strategic Suez Canal, siphoning transit fees from an unstable Egypt, while the seizure of supertankers in the Indian Ocean underscores the vulnerability of the world's oil supply. Governments, private industry, and international organizations have mobilized to address the threat. This is the first volume to examine their work in developing naval strategy, international law and diplomacy, and industry guidelines to suppress contemporary maritime piracy. The pirates of Somalia have shaken the maritime world. They have mounted what amounts to the most substantial non-state threat to the security of international shipping for half a century and perhaps longer. Piracy outbreaks have also occurred in Southeast Asia and West Africa. In each case the international community has responded differently. What lessons can be learned from three different approaches and is it possible to distill lessons of international best practice that can be applied in the Gulf of Aden and the northern Arabian Sea? This paper will examine how and why these three piracy outbreaks arose. It will describe in particular why the threat off Somalia grew so rapidly, why it declined and why the elements that made it successful remain in place. It will examine the responses of the international community, asking whether or not the response off Somalia might have been more effective if it had benefitted from stronger international backing and more coherent coordination. It will make the point that maritime security – the prevention and suppression of disorder at sea – must address many more issues than piracy as the theft of fish and the movement of drugs; weapons and people can often present greater risks. It will build on this point by looking at maritime security developments drawn from all three regions that may be employed advantageously in the Gulf of Aden and Arabian Sea, before circling back to look at the fundamental problem, which is one of landward security and asking what initiatives have been taken to address this in Somalia and which ones appear to be yielding results. Finally, it will examine whether the way forward does lie with a unified global initiative, or if steps are better taken regionally calling upon extra-regional support as necessary.

"Piracy in the waters off the Horn of Africa (HOA) has become a multi-million dollar venture annually for modern day pirates because vessel ownership groups continue to pay ransoms. The seizing of cargo ships and ransom demands have harmful economic impacts to companies and countries. Piracy operations directly threaten U.S. interests and citizens, as displayed during a recent kidnap for ransom action that led to the deaths of four Americans. In addition, piracy affects global trade. Despite significant multinational counter piracy efforts, which has included U.S. agencies and military forces, merchant vessels continue to be pirated regularly. Piracy off the coast of Somalia exists largely because Somalia is a failed state with little to no rule of law or domestic law enforcement capability. The economic situation of the people living in Somalia is dire. A lack of viable employment opportunities, a shortage of arable land, continuing drought, and increasing competition from other nations fishing off the coast, have all affected the standard of living. The conventional wisdom is that the solution lies ashore; meaning the establishment of good governance and economic development in Somalia, but the international community has displayed no interest to engage in nation building. This thesis will describe the challenges and ineffectiveness of current multi-national counter piracy operations and discuss how the international community can best combat piracy in the HOA region from a maritime perspective. By reviewing how states have historically responded to piracy and examining international legal approaches, the author will propose a multi-tiered coalition-based naval force solution, which uses all the traditional advantages of naval power to eliminate piracy without resorting to nation building."--Abstract.
