Synopsis Claims on Highway Contracts by : Robert N. Hunter

Most civil engineering projects carried out in the UK which are concerned with the construction or maintenance of highways employ the 5th edition of the ICE Conditions of Contract and the Manual of Contract Documents for Highway Works. In order to maximise returns in construction works (or often, nowadays, to minimise losses) it is necessary for engineers, contractors and clients to have a full understanding of these documents, particularly those elements which have a financial connotation. Claims on highway contracts has been specifically written to explore those parts of the 5th edition of the ICE Conditions of Contract and the Manual of Contract Documents for Highway Works which are particularly important in the commercial aspects of highway contracts and to examine how they apply in claims situations. There have been many books written on claims by lawyers which are full of legalese. Claims on highway contracts is the first, and only book which has been written by a practising engineer who works in this field and has experience of the claims minefield to provide advice in a practical and straightforward manner.

Synopsis Completing the "Big Dig" by : Transportation Research Board

Boston's Central Artery/Tunnel Project, a 7.8 mile system of bridges and underground highways and ramps, is the most expensive public works project ever undertaken in the United States. The original cost estimate of $2.6 billion has already been exceeded by $12 billion, and the project will not be completed until 2005, seven years late. The Massachusetts Turnpike Authority (MTA), the public steward of the project, requested that the National Research Council carry out an independent assessment of the project's management and contract administration practices, with a focus on the present situation and measures that should be taken to bring the project to a successful conclusion. This report presents the committee's findings and recommendations pertaining to cost, scheduling, and transitioning from the current organization dominated by consultants to an operations organization composed largely of full-time MTA staff. The report recommends that MTA establish an external, independent, peer-review program to address technical and management issues until the transition to operations and maintenance is complete; begin a media campaign now to teach drivers how to use the new system safely; and develop, immediately implement, and maintain a comprehensive security program.

Synopsis Resolution of Disputes to Avoid Construction Claims by : Barry B. Bramble

This synthesis report will be of interest to transportation agency administrators, including contract administrators; construction, design, claims, and scheduling engineers; project staff and managers; attorneys; and construction contractors. This synthesis describes the state of the practice with respect to procedures used throughout the United States to resolve disputes to avoid construction claims. Fair and timely resolution of contract disputes may help lessen highway construction project administrative costs, benefitting the public, the agency, and the contractor. This report of the Transportation Research Board examines the underlying reasons for contract disputes and identifies methods for dispute avoidance and resolution. It complements the information in NCHRP Synthesis of Highway Practice 105: Construction Contract Claims: Causes and Methods of Settlement, which focused on the causes of disputes. This synthesis further emphasizes finding ways to settle disputes at their inception, before they become formal claims or lawsuits.
