In this volume marking the Sesquicentennial of Confederation in Canada, leading scholars and jurists discuss the evolution of the Canadian Constitution since the British North America Act 1867; the role of the Supreme Court in interpreting the Constitution as a 'living tree' capable of application to new legal issues; and the growing influence of both the Constitution, with its entrenched Charter of Rights and Freedoms, and the decisions of the Court on other constitutional courts dealing with a wide range of issues pertaining to human rights and democratic government. The contributors assess how the Canadian Constitution accommodates the cultural diversity of the country's territories and peoples while ensuring the universal applicability of its provisions; the role of the Court in interpreting and applying the Constitution; and the growing global influence of the Constitution and decisions of the Court on legislatures and courts in other countries.

Porter's well-known ex-student Wallace Clement provides the introduction for this volume, and Richard Helmes-Hayes has compiled an updated bibliography of writings by and about John Porter.

This volume examines 150 years of Canadian political life in light if one of the country's most intractable problems, its cultural identity. Although many thoughtful Canadians remain dubious about the existence of a truly Canadian way of life, Douglas Verney argues that in fact Canada's political traditions embody and reflect a unique culture; and that although the Canadian government has been the primary instrument for nurturing this culture, it has been at the same time the entity most guilty of obscuring and ignoring it.

Throughout the world, liberal-democracies are grappling with increasing claims made in the name of minority national, socio-cultural and ethno-cultural identities that seek greater recognition in the institutions of the nation-state. This work inserts itself into debates centred on diversity through a normative and empirical analytical assessment of the political sociology of multinational democracies. The main thread of the arguments put forward is that federalism, in both its institutional manifestations and its sociological properties, constitutes a promising avenue for the management of cohabitating political communities and for the affirmation of collective identities within states that are constituted by two or more nations. Author Alain-G Gagnon develops his argument by contending that the federal principle allows for the exercise of advanced democratic practices within nation-states, permitting internal nations to openly affirm the bases of adherence to a common political project. At the same time, he argues that federalism nourishes the development of distinct collective traditions that serve to benefit all parties to the association. It is concluded that only in such a scenario will the elusive pursuit of an authentic and shared loyalty underpin multination states and ensure their stability, in contrast to the instrumental sentiments of belonging engendered by procedural territorial federal models. Focusing primarily on the Canadian case, this book also draws inspiration from other federal states (Belgium, the United States), as well as federalizing states (Spain, the United Kingdom). The first graduate conference of the Young Scholars' Network of the Association for Canadian Studies in German-speaking countries took place in Berlin in 2004. The conference has been an integral part of the academic year in Canadian Studies ever since. It offers an opportunity for young scholars to present their B.A., M.A. and Ph.D. projects and receive feedback and helpful suggestions from peers and experts. This type of academic exchange is particularly important in Canadian Studies as they often occupy a marginal position at universities. Beside graduate students from Canada, Germany and Austria, prominent Canadian scholars have also been invited to speak at the conference every year. This volume contains selected contributions (in English, German and French) presented at the first five graduate conferences and demonstrates the large scope of Canadian studies in German-speaking countries. Die erste Graduiertentagung für Kanada-Studien des Nachwuchsforums der Gesellschaft für Kanada-Studien e. V. (GKS) wurde 2004 in Berlin veranstaltet. Language in Canada provides an up-to-date account of the linguistic and cultural situation in Canada, primarily from a sociolinguistic perspective. The strong central theme connecting language with group and identity will offer insights into the current linguistic and cultural tension in Canada.
