The veiling of Muslim women has become a highly debated challenge in the Western world, ranging from religious freedom, integration, and gender equality topics. Despite legally guaranteed human rights, discrimination against Muslims, especially towards veiled Muslim women, persists. This one-of-a-kind research looks at the topic from a completely new perspective as it researches the impact of a potential veiling ban on the quality of life of veiled Muslim women in Slovenia by employing different research methods, like qualitative (interviews) and quantitative methods (surveys). By drawing on critical racial feminism and pragmatic philosophy, the study evaluates the proportionality of such bans in balancing individual rights and public interests. Examining experiences from other Western countries, the research offers insights into the consequences of veiling bans on societal attitudes and integration. It aims to inform policy debates and promote a deeper understanding of the complex intersections between religion, culture, and human rights in the Western context.

One of the most remarkable aspects pertaining to the legal bans and societal debates on the face veil in Europe is that they rely on assumptions which lack any factual basis. To rectify this, Eva Brems researched the experiences of women who wear a face veil in Belgium and brought her research results together with those of colleagues who did the same in four other European countries. This book contains an in-depth examination of the Islamic headscarf cases of the Court of Justice of the European Union (CJEU) and places these against the background of the Islamophobia existing across Europe. It assesses how EU law can best protect women who want to wear headscarves at work for religious reasons and why this protection is important not only for the women themselves but also for the EU, taking into account its values as laid down in the Treaties, the Charter of Fundamental Rights of the EU and in the anti-discrimination Directives. It puts forward arguments for a finding that workplace neutrality bans constitute direct religion or belief discrimination and examines the way that the justification test for indirect discrimination has been applied by the CJEU. The work suggests that such bans could be more successfully challenged as gender and/or racial or ethnic origin discrimination, because the protection against these forms of discrimination is stronger. It also suggests that a claim for intersectional discrimination – on the grounds of gender, racial and ethnic origin, and religion or belief – should be possible in EU anti-discrimination law.
