Synopsis A Treatise on the Law of the Measure of Damages for Personal Injuries by : George P. Voorheis

Excerpt from A Treatise on the Law of the Measure of Damages for Personal Injuries: Including Suggestions on Pleading, Evidence, and Province of Court and Jury, Applicable to the Trial of This Class of Cases There seems to to be a confusion in regard to What is meant by bodily injury. Some authorities hold that bodily injury must be based upon and be confined to some present and immediate physical injury: The test of an injury is its effect upon the body or mind, for the mind is a part of the body when considered in this relation. If the effect of an injury be physiological, rather than psychological, it is a basis for damages. Keeping this rule in mind, the solution of the question becomes easy. The physiological effect may be, but it need not necessarily be, an immediate effect so long as it is the proximate result of the injury as subsequently manifested. Suffering does not depend upon a physical blow, but if suffering be caused it becomes a factor to be recognized and considered, in cause and effect, as any other result, whether it be physical or mental - whatever the degree of difference is between them.
