Excerpt from A Treatise on Equity Jurisprudence, as Administered in the United States of America: Adapted for All the States, and to the Union of Legal and Equitable Remedies Under the Reformed Procedure The purpose of the editor in preparing the present abridgment of his father's work, for the use of students in law schools, appears to call for little defense or explanation. Between one-third and two fifths of the text has been omitted, and the greater part of the notes; all except/ such as seemed essential to a clear understanding of the text. No part of the text has been re-written. By the sacrifice of some details of comparatively little importance to the American student (as in the chapters on Election, Satisfaction, and Perform ance, 461 of matters peculiar to the jurisdiction in individ ual states (as in 299 and by the free use of cross references (e. G., see 70-88, 151 it has been found possible to preserve intact those full discussions of the foundation and rationale of the various equitable doctrines which are the chief excellence of the work. The index (with some regret) has been greatly shortened; on the other hand, the chapter analyses have been retained without omissions, for the purpose of showing the author's full scheme of treatment of the various subjects.
