Synopsis The Social Responsibility of Ownership by : Hanoch Dagan
Gregory Alexander's new book The Global Debate over Constitutional Property provides a unique opportunity to reflect upon the functions of comparative law and the nature of ownership. This Comment highlights the role of comparative law in upsetting law's tendency to turn contingency into necessity, but also warns against the illusion that comparative law can yield normative conclusions without an independent and critically constructive legal inquiry. The Comment offers such an inquiry in order to substantiate Alexander's call to adopt the German constitutional model of incorporating social responsibility into the concept of property. It studies the reasons as well as the potential risks entailed by such a move, and outlines the contours of a takings doctrine that takes the social responsibility of property owners seriously.

Synopsis Stakeholders and Corporate Social Responsibility by : Nicolai J. Foss
We argue that the stakeholder and CSR literatures can benefit from more systematic thinking about ownership. We discuss general notions of ownership in economics and law and the entrepreneurial notion of ownership we have developed in prior work. On this basis, we argue that stakeholder theory needs to deal more systematically with ownership as an economic function that can be exercised with greater or lesser ability, may be complementary to other economic functions, and works better when assigned to homogeneous groups. Some stakeholder groups are likely to lack what we call “ownership competence,” even if they have made relationship-specific investments, in part because of diverse interests. We also discuss CSR from the perspective of ownership and support Friedman's original position, but with a twist. The point of Fried-man's paper is not that firms “should” maximize profits, but that managerial pursuit of “socially responsible” activities in a discretionary way imposes costs on owners. We suggest this problem is exacerbated with entrepreneurial managers who can devise new ways to disguise self-interested actions as CSR initiatives.

Synopsis Problems Associated with Community Share Ownership Trust in Rural Development by : Nevison Shumba
Bachelor Thesis from the year 2013 in the subject Agrarian Studies, grade: 2.1, Lupane State University, language: English, abstract: This work focuses on the problems associated with community share ownership trust in rural development. It analyzes the aspect of corporate social responsibility in particular. Community Share Ownership Trusts are increasingly becoming popular and popular as a means of community economic empowerment. However, there is very limited documented stock of knowledge on the frequency of their use, their validity in ensuring economic empowerment, structures and regulations governing their operation, or the factors that enable and constrain their effectiveness. The government of Zimbabwe recently introduced the Community Share Ownership Trust legitimized by the indigenization and Economic Empowerment Act of March 2010. The indigenization Act is a national policy which stipulates that the native citizens of Zimbabwe should be the majority shareholders of almost every business entity operating in Zimbabwe. The policy precisely states that 51% of the shares should belong to Zimbabweans with the community owning 10% of the 51%. Community Share Ownership Trust (CSOT) as an imaging rural development approach is proving to be effective. The approach has been implemented in countries like South Africa, India and others. It is a hybrid of Corporate Social Responsibility (CSR) which was coined in Europe in 1890s. Corporate social responsibility lacked legal force to enforce the corporate world to compensate the communities of the damage left during their operations. This led to the emergence of CSOT in developing countries. While there are benefits attributed to the implementation of CSOT there are challenges that are also associated with it. The implementation of CSOT as a rural development approach is marred with a number of challenges which are both administrative and operational. It is constrained by funding, lack of managerial skills, limited community participation, poor communication, and lack of community sense of ownership among others. The strength of CSOT lies in the active participation of communities in development initiatives. CSOT promotes dialogue and community interaction, this is good for development as it brings social bond. It also promotes sustainable use of natural resources, management and protection. It encourages efficient and equitable distribution which is important for communities to participate in the economic mainstream. CSOT promotes economic empowerment, capacity building and community participation.

Synopsis Excess by : Kim Humphery
Over-consumption is one of the key issues of our time, especially in the Western world. Over the past decade, in the face of historically unprecedented levels of consumer spending in the West - and the more recent impact of recession - a vigorous politics of anti-consumerism has emerged in a range of wealthy nations. This timely and original new book provides a comprehensive overview and analysis of what has come to be called the 'new politics of consumption'; a politics embodied in movements such as culture jamming, simple living, slow food and fair trade. The book offers an examination of anti-consumerism at a time when the idea of 'consumer excess' is being re-framed by a global economic downturn, and crucially explores what this means for the future of political debate. Drawing on interviews with activists across three continents, and offering a refreshingly accessible discussion of contemporary commentary and theory, Kim Humphery sympathetically explores anti-consumerism as cultural interpretation, lifestyle change, and collective action. Whilst analysing the positive advances of the anti-consumerist movement, Excess also challenges contemporary critical thinking on consumption, taking issue with the return to theories of mass culture in contemporary anti-consumerist polemic. Alternatively, Humphery begins to forge a politics of anti-consumerism that addresses the complexity of material acquisition and which avoids treating consumers as mere dupes in the logic of capitalism, viewing them instead as active participants in a culture which is capable of transformation.
