Synopsis Refining Child Pornography Law by : Carissa Byrne Hessick

The legal definition of child pornography is, at best, unclear. In part because of this ambiguity and in part because of the nature of the crime itself, the prosecution and sentencing of perpetrators, the protection of and restitution for victims, and the means for preventing repeat offenses are deeply controversial. In Refining Child Pornography Law, experts in law, sociology, and social work examine child pornography law and its consequences in an effort to clarify the questions and begin to formulate answers. Focusing on the roles of language and crime definition, the contributors discuss the increasing visibility child pornography plays in the national conversation about child safety, and present a range of views regarding the punishment of those who produce, distribute, and possess materials that may be considered child pornography.

Synopsis The History of the Child Pornography Guidelines by : United States Sentencing Commission

The United States Sentencing Commission ("Commission") was created by Congress to "establish sentencing policies and practices for the Federal criminal justice system" that implement the Sentencing Reform Act of 1984 ("SRA"),1 including the purposes of sentencing enumerated at 18 U.S.C. 3553(a)(2).2 In establishing such policies and practices, principally through the promulgation of federal sentencing guidelines and policy statements, the Commission's efforts are guided by the substantive and procedural requirements of the SRA and other congressional sentencing legislation. The SRA directs that the Commission "periodically shall review and revise, in consideration of comments and data coming to its attention, the guidelines."3 To this end, the Commission has established a review of the child pornography guidelines as a policy priority for the guidelines amendment cycle ending May 1, 2010.4 This report is the first step in the Commission's work on this priority. Congress has been particularly active over the last decade creating new offenses, increasing penalties, and issuing directives to the Commission regarding child pornography offenses. Indeed, in 2008, the 110th Congress passed three new laws amending child pornography statutes and creating a new offense for creating child pornography throughadapting or modifying a depiction of a child.5 Prompted by congressional action, and on its own initiative, the Commission has reviewed and substantively revised the child pornography guidelines nine times. This report describes the nine revisions made to the possession and trafficking in child pornography guidelines and the guidelines' relation to the requirements imposed on the Commission by related legislation and the SRA

Synopsis Adolescent Sexual Behavior in the Digital Age by : Fabian M. Saleh

The nexus between the digital revolution and adolescent sexual behavior has posed significant challenges to mental health practitioners, attorneys, and educators. These digital technologies may facilitate dangerous behaviors and serious consequences for some youth. Adolescent Sexual Development in the Digital Age considers adolescent sexual behavior in both clinical and legal contexts and provides a basis for clinicians, legal professionals, educators, policy makers, parents and the general public to understand the impact that technology has on human growth and development. The book's contributing authors are leading authorities in adolescent development, law, and ethics, fostering an interdisciplinary dialogue within the text. New technology poses many opportunities for both normal and risky sexual behavior in youth; including "sexting," social networking, cyber-sexual harassment, commercial exploitation of children, and child pornography. Beyond just cataloging the various technologies impacting sexual behavior, this volume offers guidance and strategies for addressing the issues created by the digital age.

Synopsis Epidemic by : Lori Handrahan

The problem of child sex abuse and its cover-up is real. A generation of American children are being destroyed. If you think this happens to someone else’s children and your children are safe, you are mistaken. Your children might be enduring sexual abuse right now while you remain dangerously ignorant. America’s appetite for child pornography puts all our children at risk. Your children and mine. Whether you acknowledge it or not. This book is a wake-up call about a subject too few people want to discuss. That is, while no one was watching, America has become a child pornography nation.

Synopsis Confronting Commercial Sexual Exploitation and Sex Trafficking of Minors in the United States by : National Research Council

Every day in the United States, children and adolescents are victims of commercial sexual exploitation and sex trafficking. Despite the serious and long-term consequences for victims as well as their families, communities, and society, efforts to prevent, identify, and respond to these crimes are largely under supported, inefficient, uncoordinated, and unevaluated. Confronting Commercial Sexual Exploitation and Sex Trafficking of Minors in the United States examines commercial sexual exploitation and sex trafficking of U.S. citizens and lawful permanent residents of the United States under age 18. According to this report, efforts to prevent, identify, and respond to these crimes require better collaborative approaches that build upon the capabilities of people and entities from a range of sectors. In addition, such efforts need to confront demand and the individuals who commit and benefit from these crimes. The report recommends increased awareness and understanding, strengthening of the law's response, strengthening of research to advance understanding and to support the development of prevention and intervention strategies, support for multi-sector and interagency collaboration, and creation of a digital information-sharing platform. A nation that is unaware of these problems or disengaged from solutions unwittingly contributes to the ongoing abuse of minors. If acted upon in a coordinated and comprehensive manner, the recommendations of Confronting Commercial Sexual Exploitation and Sex Trafficking of Minors in the United States can help advance and strengthen the nation's emerging efforts to prevent, identify, and respond to commercial sexual exploitation and sex trafficking of minors in the United States.
