This book describes the historical development of the Polish and English lingua legis. The intention is to point out the major differences between the legal realities, which significantly affect the process of translation. Secondly, the following characteristic features of lingua legis, concerning the level of words and syntagmas, are touched upon: vocabulary used in lingua legis including technical and semi-technical terms, conservatism of legal texts (Latin and Latinisms; synonymous strings, archaic adverbs etc.), borrowings, terms with non-precise meanings (the problem of indeterminacy), neologisms, euphemisms, vulgarisms, performative verbs, metaphors and religious elements, prepositional phrases, time expressions, compound nouns and the problems connected with nominalization, false cognates which cause major misunderstandings, and finally methods of providing translation equivalents. The problem of ambivalence is analysed as well. The problems connected with the Polish-English and English-Polish translation of the texts belonging to the following legal genres are examined: university diplomas and certificates, statutes, judgments, law reports, powers of attorney, petitions, contracts and deeds, testaments, birth, death and marriage certificates, and popular fiction.

As a result of globalization, cross-border transactions and litigation, and multilingual legislation, outsourcing legal translation has become common practice. Unfortunately, over-reliance on such outsourcing has given rise to significant dangers, including information asymmetry, goal divergence, and risk. Legal Translation Outsourced provides the only current reference on commercial legal translation performed outside institutions. Juliette Scott casts a critical eye on the practice as it now stands, offering an analysis of key risks and constraints. Her work is informed by empirical data of the legal translation outsourcing markets of 41 countries. Scott proposes original theoretical models aimed both at training legal translators and informing all stakeholders, including principals and agents. These include models of legal translation performance; a classification of constraints on legal translation applying upstream, during and downstream of translation work; and a description of the complex chain of supply. Working to improve the enterprise itself, Scott shows how implementing a comprehensive legal translation brief--a sorely needed template--can significantly benefit clients by increasing the fitness of translated texts. Further, she opens a number of avenues for future research with an eye to translator empowerment and professionalization.

This volume is a study into the norms that come into play in the translation of European Union legislation. With a focus on expressions of modality, the study adopts a corpus-based Descriptive Translation Studies approach to analyse the translation strategies used in a bilingual English/Italian parallel corpus of European Union legislation and identify the most frequent translational patterns. The book outlines the principles at the basis of the multilingual policy at the European Union and provides a detailed outline of the context in which the drafting and translation processes take place as a key to understanding the translational choices. The impact of sometimes contrasting factors such as the conventions of legal drafting at the European Union and those within the target culture, the principle of equal authenticity and the attention to the quality and readability of legislative texts is revealed in the analysis. Synopsis Observing Eurolects by : Laura Mori
Focusing on the multi-faceted topic of Eurolects, this volume brings together knowledge and methodologies from various disciplines, including sociolinguistics, legal linguistics, corpus linguistics, and translation studies. The legislative varieties of eleven EU official and working languages (Dutch, English, Finnish, French, German, Greek, Italian, Latvian, Maltese, Polish, Spanish) are analyzed using corpus methodologies in order to investigate the variational dynamics and translation-induced patterns of the different languages. The underlying assumption is that, within the sociolinguistic continua of the EU languages, it is possible to single out specific legislative varieties (Eurolects) that originate at a supra-national level. This research hypothesis is strongly supported by the empirical findings derived from detailed corpus analyses of each language. This work represents the first systematic and comprehensive linguistic research conducted on a wide range of EU languages using the same protocol and applying corpus methodologies to the extensive Eurolect Observatory Multilingual Corpus.
