This book offers an in-depth investigation of the emergence and spread of social mobilizations that transcend ethnicity in societies violently divided along ethno-national lines. Using Bosnia Herzegovina as a case study, the book explores episodes of mobilization which have superseded ethno-nationalist cleavages. Bosnia Herzegovina emerged from the 1992–95 war brutally impoverished and deeply ethnically divided, representing a critical and strategic case for the examination and understanding of the dynamics of mobilization in such divided societies. Despite difficult circumstances for civic-based collective action, social mobilizations in the country have grown in size, number and intensity in recent years. Marked by citizen demand for accountable governance, responsive urbanism, and access to basic human rights, these protests have been driven by economic, social and political problems which cut across religious and ethnic divides. How do Family and Medical Leave Act rights operate in practice in the courts and in the workplace? This empirical study examines how institutions and social practices transform the meaning of these rights to recreate inequality. Workplace rules and norms built around the family wage ideal, the assumption that disability and work are mutually exclusive, and management's historical control over time all constrain opportunities for social change. Yet workers can also mobilize rights as a cultural discourse to change the social meaning of family and medical leave. Drawing on theoretical frameworks from social constructivism and new institutionalism, this study explains how institutions transform rights to recreate systems of power and inequality but at the same time also provide opportunities for law to change social structure. It provides a fresh look at the perennial debate about law and social change by examining how institutions shape the process of rights mobilization.

Many developing countries pursue policies of rapid industrialization in order to achieve faster economic growth. Some policies cause displacement forcing many individuals to take up a fight against the state. Interestingly some of these dissenting individuals are more successful in organizing their protests than others. In this book, Ashok Swain demonstrates how displaced people mobilize to protest with the help of their social networks. Studying protests against large industrial and development projects, Swain compares the mobilization process between a traditionally protest rich and a protest poor region in India to explain how social network structures are a key component to understand this variation.
