Synopsis Human Rights and Diversity: New Challenges for Plural Societies by : Eduardo J. Ruiz Vieytez
The democratic management of cultural diversity is the greatest political challenge for present-day European societies. The plural character of our societies forces us to rethink the basic political concepts, starting off from a new idea of inclusive and plural d¬emocracy. The application of human rights must be reconsidered in the light of presentday reality so that democratic states are able to guarantee the benefi t of these rights to all persons through their identity and not in spite of it, thus creating political spaces that are open to a multi-identity coexistence.

Synopsis Human Rights and Diverse Societies by : François Crépeau
Over sixty years after the Universal Declaration of Human Rights, it has been widely observed that human rights resonate differently in various settings. This book addresses the timely and important question of how to understand human rights in a world of increasing diversity. The effects of globalization and the increasing mobility of persons and peoples have further deepened and multiplied the sites of interaction between different cultures, religions and ethnicities. These changes have been a source of enrichment, as multiculturalism, interculturalism and diversity permeate our daily lives. Yet, they have also revealed important societal cleavages, different conceptualizations of human rights, and divergent values and beliefs about moral, ethical, cultural and religious issues. In societies characterized by diverse social, ethnic, religious and cultural communities, it becomes critical to examine how to reconcile the tensions between respect for group-based identities and differences, the robust protections of individual rights and freedoms, and the maintenance of community solidarity and social cohesion. It is these tensions, mediated through debates about the interaction between human rights and diversity, that this book addresses. Eschewing any simple reconciliation of human rights and universalism, this book aspires to identify alternative frameworks that can facilitate the conceptualization of, and help find solutions to, the complex global human rights issues in diverse societies. In engaging with both the theoretical perspectives that question the 'universality' of human rights as well as assessing the practicality of diverse applications of human rights, this collection of essays explores how human rights can be employed to empower historically excluded and marginalized groups. Taking diversity into account in thinking about the universal aspirations of human rights protection requires us to reframe the question. Rather than asking whether human rights are universal, we need to ask how the universal principles underlying human rights are practically and tangibly realized in diverse contexts and communities. Through critical reflection and a reexamination of the concepts, categories, institutions and frontiers of human rights, this book contributes to an ongoing dialogue about human rights discourse and theory. Yet beyond its contribution to scholarly debates, it is our hope that this book will contribute to the development of concrete, tangible and institutional strategies for advancing the protection of human rights in diverse societies.

Synopsis Language Policy and Conflict Prevention by : Iryna Ulasiuk
Language policy can promote stability. For many individuals and groups, language is a key component of identity, and threats to it can raise tensions. Respect for linguistic rights, whilst also considering a state’s need to maintain cohesion, reduces conflict potential. The OSCE High Commissioner on National Minorities promotes functional solutions to such contentious issues, and the Oslo Recommendations regarding the Linguistic Rights of National Minorities address these challenges. This book analyses the components of a balanced legal and policy framework on language use, with a view to preventing conflict. In addition to reviewing the work of the OSCE HCNM in this area, it also draws upon the expertise of other international organisations and leading academics working in this field. Synopsis Minorities, their Rights, and the Monitoring of the European Framework Convention for the Protection of National Minorities by : Tove H. Malloy
In Minorities, their Rights, and the Monitoring the European Framework Convention for the Protection of National Minorities, Malloy and Caruso have collected a number of essays authored by prominent European experts on minority rights with aim to provide a first ever description and analysis of the processes guiding the monitoring of the Convention. The volume addresses both the technical and political side of the monitoring, and it brings in not only views from the host of the Convention, the Council of Europe, but also from the external players that interact with the Convention in the course of seeking to protect Europe’s national minorities

However, regional and local authorities also play a very important role in relation To The charter as they are confronted on a daily basis with the use and protection of minority languages

Synopsis Institutional Accommodation and the Citizen by : Council of Europe
The question of accommodations that institutions and citizens must make to ensure social cohesion in pluralist societies is of concern to the Council of Europe. How will we live and interact together in diversity? It is becoming increasingly important to provide responses and devise innovative frameworks (in the legal sphere, in national education and training in competences and in institutional practice) which can help build a shared vision while at the same time respecting each individual. By comparing European and Canadian responses, among others, the articles featured in this volume explore this complex issue. They contribute to a major social debate and outline a vision of the future that allows us to set aside mutual suspicion and develop institutional arrangements and forms of social interaction capable of making diversity a factor for progress, well-being and social justice. They also remind us that poverty combined with stigmatisation based on identity leads to stasis, social malaise and an increase in security measures, which ultimately prevent societies from evolving through risk taking, shared responsibility, dialogue and consultation.

Synopsis Shaping Language Rights by : Alba Nogueira López
The European Charter for Regional or Minority Languages protects and promotes traditionally used regional or minority languages in Europe. This volume provides an in-depth analysis of the provisions of the Charter in light of the monitoring work done by the Committee of Experts since 2001. An article-by-article commentary by legal experts examines the meaning and implications of the provisions of the Charter and studies best practice and shortcomings in its implementation by states parties.
