Synopsis Personal Property Securities Act by : Linda Widdup
Almost ten years have elapsed since the revised edition of "PPSA a conceptual approach" was published. Both the first edition and the revised edition were published prior to the time the PPSA came into force in New Zealand in May 2002. As a result, the book does not include references to any New Zealand case law. Therefore, the primary purpose in writing a new edition is to include commentary and references to relevant New Zealand case law. In addition, the new edition will also include commentary and references to relevant Canadian case law that has arisen since 2002. A substantial body of case law has developed since 2002. Australia has also enacted a PPSA which is scheduled to come into force in early 2012. The new edition of the book will also include some reference to Australian legislation for comparative purposes and to the extent it contributes to the discussion on issues arising in New Zealand. In my view, an updated edition of the book will appeal to the New Zealand market as well as the Australian market (although please see the market research info at 11 below). This book's unique selling point is its conceptual approach rather than the section by section analysis and commentary which prevails in other publications dealing with the PPSA as a subject matter. The conceptual approach brings relevant issues together which is helpful. Several practitioners in Australia have commented that due to the conceptual approach, they recommend this book as the book to start with when learning about the changes brought by the PPSA. The structure of the current text is unlikely to change as the developments in the law will generally be accommodated within the existing chapters. However there are some emerging issues that might be dealt with better in separate chapters, so additional chapters may be included.
