Synopsis Flinders Aluminum Fabrication Corporation v. Mismo Fire Insurance Company by : Rebecca Sitterly

Flinders Aluminum Fabrication Corporation burned to the ground on the night of November 16. George Avery, an employee of the plant, died inside. Plaintiff Jackson, the sole stockholder of the company, has filed a civil action lawsuit to recover damages owed from the policy issued by defendant Mismo Fire Insurance Company. The defendant has refused to pay, claiming that the fire was the work of an arsonist, thus indicating deliberate fraud. Mismo asserts that Jackson conspired with others to burn the plant in order to collect what was promised in the insurance policy. This breach-of-contract case file has four witnesses for both the plaintiff and the defendant. Videos of the fire, deposition statements, and a PowerPoint presentation are included as free downloads. A companion criminal case file, State v. Jackson, involves the charge of arson against Arthur Jackson. Both case files are NITA classics that have been updated in 2017. Read more about the case files in this interview with two of their authors.

Synopsis Flinders Aluminum Fabrication Corporation V. Mismo Fire Insurance Company by : Rebecca Sitterly

When the Flinders Aluminum Fabrication Corporation burns to the ground, killing George Avery, suspicion falls on CEO Arthur Jackson. In fact, Mismo Fire Insurance Company is so certain that the fire was deliberately set that it has denied the insurance claim. Jackson, the sole stockholder in the financially troubled corporation, has filed a civil action to recover damages against Mismo for the denied claim. Mismo asserts that Jackson conspired with others to burn the plant in order to fraudulently collect the insurance policy. Did we mention that the deceased Avery is a suspected “torch,” implicated in the burning of two other commercial buildings in Nita City? That reputation isn’t helping Jackson’s case, but he claims he hired Avery, a talented designer, to help him modernize the Flinders plant. The intrigue grows when it is revealed that one of the witnesses against Jackson has a serious axe to grind that could be clouding her vision. This entertaining file presents a well-balanced case that can be also tried as a condensed or an advanced experience. Synopsis State V. Jackson by : Laurence M. Rose

The State of NITA has charged Arthur Jackson and his assistant, Sonia Peterson, with commercial arson. Prosecutors allege that the two conspired with George Avery to burn down the Flinders Aluminum Fabrication factory. The original trial resulted in a hung jury, after which Sonia Peterson pled guilty to conspiracy to commit a felony and agreed to testify against Arthur Jackson. Jackson maintains his innocence. Avery cannot testify because he died in the fire. There are four witnesses for both the State and the defense. Videos of the fire, deposition statements, and a PowerPoint presentation are available as free downloads. A companion civil case file, Flinders v. Mismo, involves Jackson suing to recover from the company that insured the plant. Synopsis The Yudahua Business Group in China's Early Industrialization by : Juanjuan Peng

By tracing the history of Yudahua from the late nineteenth century to the middle of the twentieth century, this study analyzes a successful inland business model among textile companies in modern China. The steady growth of this enterprise relied primarily on its strategy to focus on low-end markets and to locate new mills in underdeveloped interior regions. This strategy further allowed the enterprise to pioneer industrialization in its host localities, demonstrating a major social and economic impact on the local societies. At the same time, Yudahua’s unique team leadership pattern—five leading families shared its ownership and management—made the business an atypical family firm and allowed relatively easy institutional departure from Chinese social networks and adoption of Western corporate hierarchy. Therefore, by the late 1940s, Yudahua had gradually developed into a fairly integrated business group with a unified management structure and routinized connections between its member mills, which differed noticeably from the loose alliances normally found in other early twentieth-century Chinese business conglomerates.

Synopsis Modern Trial Advocacy by : Steven Lubet

Now in its fourth edition, Modern Trial Advocacy: Canada is the first and last word in Canadian trial practice. This classic handbook, published by the National Institute for Trial Advocacy, gives practitioners a detailed road map for conducting a trial. Expanding on the original text written by Steven Lubet for an American audience, experienced Toronto trial lawyers Cynthia Tape and Julie Rosenthal guide the beginning advocate in developing a winning case theory through all phases of trial. They explain how to present a case as a story – and powerfully and persuasively tell that story to the jury. Modern Trial Advocacy: Canada provides not only Canadian case law and statutes, but also valuable insight into the specific elements of Canadian litigation practice as itpresents a realistic and contemporary approach to learning and developing trial advocacy skills. This book offers a sophisticated, theory-driven approach to advocacy training that distinguishes it from other books in the field. The fourth edition has been updated with current citations to case law, statutes, and rules and the latest “best practices” for using technology in the courtroom.
