This report identifies and assesses the role that national law enforcement actors and public prosecutors in the EU member states play in helping prevent the proliferation of weapons of mass destruction (WMD) by stopping the illicit trade in dual-use items. In the 1980s and 1990s, some EU member states discovered cases of illegal trade in sensitive items for use in, for example, the Pakistani nuclear weapon programme. The report discusses how these cases were dealt with in these countries, using a case study model. Acknowledging that dual-use goods are subject to the free movement of goods within the EU, the report emphasizes the importance of coordinating customs and licensing standards among the EU member states to prevent abuse of the EU market for 'licence shopping'. It also presents the argument for the coordination of prosecution and penalties for offenders. In order to show the level of coordination that is required, the report provides an overview of both the international, EU and national legal frameworks for control of the export of dual-use goods.

This collection of essays explores the problem of nuclear, chemical and missile proliferation. Contributors discuss the role of export controls in preventing or delaying proliferation, and contrast the relative benefits of export controls with their costs to industry and to international political relationships. Particular emphasis is placed on the challenges posed by export controls to the US-European Community partnership, and to the effects of European unity following unity in 1993. The spread of weapons of mass destruction poses one of the greatest threats to international peace and security in modern times--the specter of nuclear, chemical, and biological weapons looms over relations among many countries. The September 11 tragedy and other terrorist attacks have been painful warnings about gaps in nonproliferation policies and regimes, specifically with regard to nonstate actors. In this volume, experts in nonproliferation studies examine challenges faced by the international community and propose directions for national and international policy making and lawmaking. The first group of essays outlines the primary threats posed by WMD proliferation and terrorism. Essays in the second section analyze existing treaties and other normative regimes, including the Nuclear Non-Proliferation Treaty and the Chemical Weapons and Biological Weapons Conventions, and recommend ways to address the challenges to their effectiveness. Essays in part three examine the shift some states have made away from nonproliferation treaties and regimes toward more forceful and proactive policies of counterproliferation, such as the Proliferation Security Initiative, which coordinates efforts to search and seize suspect shipments of WMD-related materials.

This edited volume examines the issue of the proliferation of dual-use technology and the efforts of the international community to control these technologies. Efforts to stop the spread of weapons of mass destruction (WMD) increasingly focus on preventing the proliferation and misuse of dual-use technologies: information, materials and equipment that can be easily applied for peaceful and hostile purposes. The threat of terrorist attacks with nuclear, biological or chemical weapons, in particular, makes it necessary to develop a sustainable non-proliferation policy that effectively hinders the misuse of dual-use technologies. In this book, leading non-proliferation experts from different regions of the world reflect on the political, legal and technical obstacles with an aim to finding a better balance between control and cooperation in dual-use technology transfer regulations. This broad approach makes it possible to compare regimes which may be structurally different but are similar in the way they attempt to regulate dual-use technology transfers by balancing controls and cooperative approaches. This book will be of much interest to students of weapons proliferation, arms control, global governance, international organizations and international security.

This book examines the evolution of international nuclear non-proliferation trade controls over time. The book argues that the international nuclear export controls have developed in a sub-optimal way as a result of a non-proliferation collective action problem. This has resulted in competition among suppliers, owing to the absence of an overarching effective system of control. While efforts have been undertaken to address this collective action problem and strengthen controls over time, these measures have been inherently limited, it is argued here, because of the same structural factors and vested interests that led to the creation of the problem in the first place. This study examines international controls from the beginning of the nuclear age and early efforts to control the atom, up to more recent times and the challenge posed by Iranian and North Korean nuclear ambitions. Drawing on a rich body of original archival research and interviews, the book demonstrates that the collective action problem has restrained cooperation in preventing nuclear proliferation and that gaps persist in the international nuclear trade control regime. This book will be of much interest to students of nuclear proliferation and arms control, security studies, and International Relations.
