Synopsis Lawyer's Code of Ethics by : Valmaer Valmaer
Excerpt from Lawyer's Code of Ethics: A Satire L. The first thing to do is, to secure vour client. How to do that depends very much upon the tact of the lawyer; a client you must have no matter at what cost or how you manage it; and it must be a real, live one. After you have him, to be sure of him, always demand a retainer. Retainers have made many lawyers rich. You can usually do this by telling him it is the rule of your othee; ind insures good faith on his part. Give him a receipt for it, to insure good faith on your part. If you are a young practitioner, it is a good plan to take down on paper all the circumstances connected with the case; then tell him you are verv busy, and, that as the case will not need your immediate attention he had better go home and return in a few days. The point is this: it gives you time to look up the authorities, and impresses the client with the fact that you are the. Synopsis Ethical Obligations of the Lawyer by : Gleason Leonard Archer
Excerpt from Ethical Obligations of the Lawyer The great movement for the uplifting of the morale of the profession of law that is sweeping the country has brought prominently to the front the subject of Legal Ethics. It has become recognized among lawyers that the old custom of leaving professional ethics to the untutored ethical instincts of the individual lawyer must now give place to a definite and positive codification of ethics. The reform movement has manifested itself in the adoption of codes of ethics by various bar associations throughout the country. The present volume is a treatise explanatory of the principles underlying the rules of professional conduct adopted by the bar associations, together with such other principles of legal ethics as would confront the lawyer in his everyday practice. Legal Ethics include not only an intelligent watchfulness to do right but also a knowledge of long established customs and traditions of the profession. Synopsis The Lawyer's Official Oath and Office (Classic Reprint) by : Josiah Henry Benton
Excerpt from The Lawyer's Official Oath and Office Most of what is contained in this book was gathered by me in the preparation of an address delivered before the Albany Law School in the Hubbard course of Legal Ethics, May 17, 1909. It has been suggested that its presentation in this form will be useful to the profession, as some of it is not otherwise easily accessible to all who are interested in the subject of the lawyer's oath and office. This, as well as my own belief that the dignity and impor tance of the lawyer's office and of the duties imposed by his official oath should be more fully understood, have caused me to print this little book. Why is any oath required for admission to the practice of the law? No oath is required by law for admission to practise in any other profession, even where qualifications to practise are prescribed or ascertained by examinations required by law, as in the case of physicians. But an official oath has always been required for admission to the practice of the law. Why is it required? What is its significance and what obligation does it impose? The significance of the lawyer's oath is that it stamps thelawyer as an officer of the State, with rights, powers and duties as important as those of the Judges of the Courts themselves. When a lawyer is admitted to practise and takes the required oath of office he has as much right to discharge the duties of his office as a representative or senator has to sit and act in the Legislature, or a Governor to exercise the functions of a chief magistrate. He has as much right to appear in Court and be heard for a party to a cause as a Judge has to hear and decide the cause. A lawyer is not t/ze servant of let's client. He is not t/ze servant of t/ze Court. He is an ofieer of the Court, with all the rights and responsibilities which the character of his office gives and imposes.
