The main focus of this book is a review of how the Common Fisheries Policy is enforced throughout the Community, with a discussion of its successes and failures. Quantitative modeling methods have become a central tool in the management of harvested fish populations. This book examines how these modeling methods work, why they sometimes fail, and how they might be improved by incorporating larger ecological interactions. Fisheries Ecology and Management provides a broad introduction to the concepts and quantitative models needed to successfully manage fisheries. The application of the Common Fisheries Policy (CFP) in the Mediterranean and Black Sea faces several challenges also because of large ecological, economic, political and institutional differences across the basin. Fisheries law enforcement, from investigation to judgement, continues to be an expensive and lengthy process in many jurisdictions. Many countries - particularly developing countries - experience such a significant backlog of pending trials for conventional criminal offences that dealing with fisheries offences is not a priority. This study suggests considering the use of administrative sanctions as a direct response to the problem and examines the administrative systems for dealing with fisheries offences in a diverse range of countries from different legal systems. It is intended to assist states in identifying the issues they need to take into account when considering the adoption of such a scheme. It is expected that the study will be especially valuable to developing states seeking to adopt a cost effective means of dealing with illegal, unreported and unregulated fishing, but which nonetheless wish to ensure that the basic individual rights of the accused are protected.

This book offers a comprehensive account of the status and dynamics of people participating in the small-scale fisheries (SSF) of Europe. It covers the situation of SSF in 25 coastal countries, thereby providing a portrait of almost every coastal country on the continent and analyzing the recent evolution of the sector. Small-scale fisheries are argued to be extremely important in Europe, as they provide employment and welfare, while increasing food sovereignty and maintaining communities in coastal areas. The recent worldwide focus on SSF derives from their environmental sustainability, which distinguishes many of their activities from those of large-scale fisheries. This book analyses the diversity of SSF and shows how fishing communities have sometimes developed successful governing models, demonstrating social and economic resilience. While the book emphasizes the strengths of SSF and the synergies that occur with other marine sectors, it also presents cases of failure, in which collective action and policy have actually contributed to a weakening of the sector. In this context, the book shows how governmental policies toward SSF vary considerably from country to country, in a way that is not entirely consistent with European policies.

The Common Fisheries Policy (CFP) is one of the longest established and more controversial of the common policies of the EC. It deals principally with the management of fishery resources, relations between the EC and third States in fisheries matters, the marketing of and trade in fishery products, financial assistance to the fisheries sector, and aquaculture. However, the CFP is not just a matter for those with an economic interest in fisheries. It also raises many issues of more general concern, such as the capacity of the EC and its Member States to manage important natural resources sustainably, the impact of fishing on the wider marine environment, and relations between developed and developing States. This book addresses the CFP from a legal perspective. It provides a detailed account of the very large body of EC law comprising the CFP, and draws on the European Commission's associated documents to aid interpretation and add context. As a result, the book will be of value to anyone wanting knowledge of the law of the CFP. Although not addressing the Commission's 2009 Green Paper on reform of the CFP, the book should provide a useful reference point against which to view the reform of parts of the CFP that is anticipated to take place over the next few years.
