About the publication This Compendium of documents relating to regional and sub-regional peace and security in Africa is the second edition to the 2006 Compendium of key documents related to peace and security in Africa (edited by Dr Monica Juma). It is both an updated and expanded attempt at consolidating the vast legal instruments broadly relating to peace and security on the African continent. More specifically, the Compendium aims to consolidate, both on the regional and sub-regional level, treaties and decisions of regional organisations pertaining to conflict prevention, management and resolution in the African regional and sub-regional context. It ultimately aims to serve as a useful research guide to those involved with matters of peace and security in Africa. Documents and legal instruments included in this Compendium focus on the Organisation of African Unity, the African Union, and its eight Regional Economic Communities: the Arab Maghreb Union (AMU), the Common Market for Eastern and Southern Africa (COMESA), the Community of Sahel-Saharan States (CEN-SAD), the East African Community (EAC), the Economic Community of Central African States (ECCAS), the Economic Community of West African States (ECOWAS), the Intergovernmental Authority on Development (IGAD), and the Southern African Development Community (SADC). This edition also includes additional documents from sub-regional organisations, including documents from the Great Lakes Region and Horn of Africa Conference on the Proliferation of Small Arms and Light Weapons, the Gulf of Guinea Commission, the Central African Economic and Monetary Community, the Eastern Africa Standby Force, the G5 Sahel, the Indian Ocean Commission, and the Mano River Union. Additionally, each chapter outlines the organisation in question, its principal institutions relating to peace and security, relevant documents and legal instruments, and listed topical decisions, declarations and communiqués by that organisation and its institutions. It also briefly puts forward the details of any military interventions or peacekeeping missions undertaken by each organisation. Of particular concern is an insistence on democracy and transparency radically different from strategic and instrumental conceptions – a space for dialogue and dissent, an opportunity for crea-tivity, experimentation and re-imaginings. About the publication In the second edition of PULP FICTIONS we continue the search for a vibrant and active public sphere through debate. As in the first edition, the dialogue is one between two academics from the faculty of law and, as in the first edition, different conceptions of law, politics and the role of the academic are teased out. The context of the debate in this edition is a series of research meetings of the Department of Legal History, Comparative Law and Jurisprudence at the UP Law Faculty. Over a course of a few of these meetings different perspectives on law, politics and the limits/ potential of the law were voiced by different colleagues.Tshepo Madlingozi presented in one of the meetings his views on the role of legal academics in progressive politics. In this contribution, which appears here, he urges all of us to move ‘beyond the ivory tower’, get out of our ‘air conditioned offices’ and embrace participatory action research. Madlingozi defines the latter as field research where the researcher interacts and participates with communities and engages in research that is ‘unashamedly’ political. Anton Kok in response takes what he calls a ‘pragmatic instrumentalist’ view in contrast to Madlingozi’s more ‘ambitious critique’. Focusing more on law’s potential he highlights the areas where law could contribute to transformation. Both colleagues are not afraid to put their personal political/ideological views on the table. In this way they contribute to the vision of creating a space for dialogue, dissent, creativity and re-imaginings. This book discusses the many legal aspects arising in relation to the maintenance of peace in Africa. Over the past twenty years, the majority of peace operations have been deployed on this continent, most of them established by the UN Security Council, sometimes in cooperation with the African Union and other African regional organizations, with contributions from the European Union and NATO. In some cases, the African Union has invoked its ‘primary responsibility for promoting peace, security and stability in Africa’, thus questioning the legal partnership between UN and regional organizations provided for in Chapter VIII of the UN Charter. The peace operations deployed in Africa have sometimes received a very robust mandate, which also includes the use of force and the protection of civilians’ human rights. The implementation of this broad mandate, which goes well beyond the traditional ‘peacekeeping approach’, requires considerable human and economic resources. Moreover, it raises several issues of concern with regard to the impact on the economic and political systems of the states in which the operations are deployed and, more generally, on the exercise of sovereignty over their territorial communities by these states. Offering an update for lawyers in practice and in academia interested in the field of international law, the book also contributes to the theoretical studies concerning the activities of international organizations, focusing on one of the most challenging issues to emerge in recent times.
