The food industry is a notoriously complex economic sector that has not received the attention it deserves within legal scholarship. Production and distribution of food is complex because of its polycentric character (as it operates at the intersection of different public policies) and its dynamic evolution and transformation in the last few decades (from technological and governance perspectives). This volume introduces the global value chain approach as a useful way to analyse competition law and applies it to the operations of food chains and the challenges of their regulation. Together, the chapters not only provide a comprehensive mapping of a vast comparative field, but also shed light on the intricacies of the various policies and legal fields in operation. The book offers a conceptual and theoretical framework for competition authorities, companies and academics, and fills a massive gap in the competition policy literature dealing with global value chains and food.

Nearly every day brings news of another merger or acquisition involving the companies that control our food supply. Just how concentrated has this system become? At almost every key stage of the food system, four firms alone control 40% or more of the market, a level above which these companies have the power to drive up prices for consumers and reduce their rate of innovation. Researchers have identified additional problems resulting from these trends, including negative impacts on the environment, human health, and communities. This book reveals the dominant corporations, from the supermarket to the seed industry, and the extent of their control over markets. It also analyzes the strategies these firms are using to reshape society in order to further increase their power, particularly in terms of their bearing upon the more vulnerable sections of society, such as recent immigrants, ethnic minorities and those of lower socioeconomic status. Yet this study also shows that these trends are not inevitable. Opposed by numerous efforts, from microbreweries to seed saving networks, it explores how such opposition has encouraged the most powerful firms to make small but positive changes.

Interestingly, some relief from today's woes may come from ancient human practices. While current agri-food production models rely on abundant supplies of water, energy, and arable land and generate significant greenhouse gas emissions in addition to forest and biodiversity loss, past practices point toward more affordable and sustainable paths. Different forms of insect farming and soilless crop farming, or hydroponics, have existed for centuries. In this report the authors make a persuasive case that frontier agriculture, particularly insect and hydroponic farming, can complement conventional agriculture. Both technologies reuse society's agricultural and organic industrial waste to produce nutritious food and animal feed without continuing to deplete the planet's land and water resources, thereby converting the world's wasteful linear food economy into a sustainable, circular food economy. As the report shows, insect and hydroponic farming can create jobs, diversify livelihoods, improve nutrition, and provide many other benefits in African and fragile, conflict-affected countries. Together with other investments in climate-smart agriculture, such as trees on farms, alternate wetting and drying rice systems, conservation agriculture, and sustainable livestock, these technologies are part of a promising menu of solutions that can help countries move their land, food, water, and agriculture systems toward greater sustainability and reduced emissions. This is a key consideration as the World Bank renews its commitment to support countries' climate action plans. This book is the Bank's first attempt to look at insect and hydroponic farming as possible solutions to the world's climate and food and nutrition security crisis and may represent a new chapter in the Bank's evolving efforts to help feed and sustain the planet.

Continued population growth, rapidly changing consumption patterns and the impacts of climate change and environmental degradation are driving limited resources of food, energy, water and materials towards critical thresholds worldwide. These pressures are likely to be substantial across Africa, where countries will have to find innovative ways to boost crop and livestock production to avoid becoming more reliant on imports and food aid. Sustainable agricultural intensification - producing more output from the same area of land while reducing the negative environmental impacts - represents a solution for millions of African farmers. This volume presents the lessons learned from 40 sustainable agricultural intensification programmes in 20 countries across Africa, commissioned as part of the UK Government's Foresight project. Through detailed case studies, the authors of each chapter examine how to develop productive and sustainable agricultural systems and how to scale up these systems to reach many more millions of people in the future. Marketing and production contracts covered 39% of the value of U.S. agricultural production in 2008, up from 36% in 2001, and a substantial increase over 28% in 1991 and 11% in 1969. However, aggregate contract use has stabilized in recent years and no longer suggests a strong trend. Contracts between farmers and their buyers are reached prior to harvest (or before the completion stage for livestock) and govern the terms under which products are transferred from the farm. Contracts are far more likely to be used on large farms than on small farms. The U.S. Department of Agriculture (USDA) requested that the Board on Agriculture and Natural Resources of the National Research Council (NRC) convene a panel of experts to examine whether publicly funded agricultural research has influenced the structure of U.S. agriculture and, if so, how. The Committee to Review the Role of Publicly Funded Agricultural Research on the Structure of U.S. Agriculture was asked to assess the role of public-sector agricultural research on changes in the size and numbers of farms, with particular emphasis on the evolution of very-large-scale operations.

The sharp fluctuations in food price inflation at a time of great uncertainty about the economic outlook have raised questions about the functioning of the European food supply chain. While the observed changes in food prices in EU Member States can be linked to developments in the global demand and supply for agricultural commodities, inefficiencies in the functioning of the food supply chain, in terms of competition and regulation, may have played an important role as well. In particular, an analysis of the transmission mechanisms linking agricultural commodity prices with producer and consumer prices shows that the shock caused by the upsurge in agricultural commodities and energy prices in the second half of 2007 and the first half of 2008 was absorbed differently across EU Member States. Crosscountry differences in the regulatory framework appear to have contributed to this fragmentation of the European Single Market. Moreover, there are indications of differences in the conditions of competition across Member States. Finally, consolidation is taking place throughout the food supply chain. While such consolidation can lead to efficiency gains, it may also worsen the conditions of competition to the detriment of consumers and businesses.
