Since the beginnings of independence, a number of African nations have been plagued by repeated coup d'états. Within the African Union (AU), there has been a concerted effort to break this cycle through the official adoption of an ‘anti-coup norm’, by which the AU is mandated to suspend a member state and restore constitutional order following a coup. Supporters of this stance see it as strengthening democracy in Africa, while critics argue that it has served to prop up existing regimes. But there has been little analysis of what the AU’s attempts to ‘restore constitutional order’ have meant for individual African states. In this book, Antonia Witt looks at the legacy of the AU’s intervention in Madagascar following the 2009 ‘Malagasy crisis’, one of the increasingly relevant yet under-researched cases of non-Western intervention in Africa. The book looks at the ways in which international intervention reconfigured the political order in Madagascar, how it facilitated the power struggle within the Madagascan elite and prevented more profound political change. It also considers what the example set by the Madagascan intervention means for the wider international order in Africa and the powers attributed to African international actors such as the AU.

Examining the harmonisation of Intellectual Property policy, law and administration in Africa, this book evaluates the effectiveness of efforts to establish continental Intellectual Property institutions and frameworks. It also considers sub-regional initiatives led by the regional economic communities and the regional Intellectual Property organisations, focusing on relevant protocols and agreements that address Intellectual Property as well as the implementing institutions. The African Union (AU) aims at creating an African Economic Community (AEC) by 2034. Eight recognized Regional Economic Communities (REC) are supposed to form the building blocs of the AEC. The book shows that the Southern African Development Community (SADC) is currently the most advanced and promising REC but still behind schedule in reaching its own integration objectives. If the currently most successful of the African RECs may not achieve sufficiently deep regional integration in time then the chances to establish the AEC by 2034 are slim indeed. This volume of the Netherlands Yearbook of International Law (NYIL) is the fiftieth in the Series, which means that the NYIL has now been with us for half a century. The editors decided not to let this moment go by unnoticed, but to devote this year’s edition to an analysis of the phenomenon of yearbooks in international law. Once the decision was made that this would be the subject of this year’s NYIL, the editors asked themselves a number of questions. For instance: Not many academic disciplines have yearbooks, so what is the reason we do? What is the added value of having a yearbook alongside the abundance of international law journals, regular monographs and edited volumes that are published on a yearly basis? Does the existence of yearbooks tell us something about who we are, or who we think we are, or what we have to contribute to the world? These questions will be addressed both in a general and in a specific sense, whereby a number of yearbooks published all over the world will be looked at in further detail. The Netherlands Yearbook of International Law was first published in 1970. It offers a forum for the publication of scholarly articles in a varying thematic area of public international law.

The African Charter on Human and Peoples' Rights (ACHPR) was the first non-Western declaration of human rights. This book, for the first time, presents a comprehensive account of the development of the ACHPR, key to a proper understanding of its fundamental nature. Volume 1 outlines the dominant African political and cultural ideas upon which the OAU (now African Union) was founded. Volume 2 describes the process through which the ACHPR came into being.
