Synopsis Ronald Dworkin by : Stephen Guest

Ronald Dworkin is widely accepted as the most important and most controversial Anglo-American jurist of the past forty years. And this same-named volume on his work has become a minor classic in the field, offering the most complete analysis and integration of Dworkin's work to date. This third edition offers a substantial revision of earlier texts and, most importantly, incorporates discussion of Dworkin's recent masterwork Justice for Hedgehogs. Accessibly written for a wide readership, this book captures the complexity and depth of thought of Ronald Dworkin. Displaying a long-standing commitment to Dworkin's work, Stephen Guest clearly highlights the scholar's key theories to illustrate a guiding principle over the course of Dworkin's work: that there are right answers to questions of moral value. In assessing this principle, Guest also expands his analysis of contemporary critiques of Dworkin. The third edition includes an updated and complete bibliography of Dworkin's work.

Synopsis A Critique of Proportionality and Balancing by : Francisco J. Urbina

The principle of proportionality, which has become the standard test for adjudicating human and constitutional rights disputes in jurisdictions worldwide has had few critics. Proportionality is generally taken for granted or enthusiastically promoted or accepted with minor qualifications. A Critique of Proportionality and Balancing presents a frontal challenge to this orthodoxy. It provides a comprehensive critique of the proportionality principle, and particularly of its most characteristic component, balancing. Divided into three parts, the book presents arguments against the proportionality test, critiques the view of rights entailed by it, and proposes an alternative understanding of fundamental rights and their limits.

Synopsis Structural Principles in EU External Relations Law by : Marise Cremona

The law and practice of EU external relations is governed not only by general objectives (Articles 3(5) and 21 TEU and Article 205 TFEU) and values (Article 2 TEU) but also by a set of principles found in the Treaties and developed by the Court of Justice, which structure the system, functioning and exercise of EU external competences. This book identifies a set of 'structural principles' as a legal norm-category governing EU external relations; it explores the scope, content and function of those principles that may be categorised as structural. With an ambitious scope, and a stellar line-up of experts in the field, the collection offers a truly innovative perspective on the role of law in EU external relations.

Synopsis Legalize This! by : Douglas Husak

Recreational drug users (other than those who take harmful substances like alcohol and tobacco) are regularly imprisoned. Nearly half a million drug offenders are incarcerated in US jails, more than the total number of prisoners in 1980 and more than the entire EU prison population. In some states more is spent on maintaining the prison system than on education. Current drug policies lead to immense personal suffering, as well as police corruption, organized crime and contempt for the law, and make drugs more dangerous because they are illegal and thus not subject to proper controls. Politicians from all sides of the political spectrum are beginning to ask: is it worth it? In arguing that criminalization is unjust, Douglas Husak explodes many of the myths that surround drug use. In some years, more than half of high school seniors take drugs, yet the US is not overrun with drug-crazed addicts. Horror stories of the dangers of drug use abound, but the truth is more prosaic; although recreational drugs are sometimes bad for users, there are between 80 and 90 million US citizens who have used illicit drugs without ill effects.
