The term "conjugal rights" has long characterized ways of speaking about marriage both in the canonistic tradition and in the secular legal systems of the West. This book explores the origins and dimensions of this concept and the range of meanings that have attached to it from the twelfth century to the present. Employing far-ranging sources, Charles Reid Jr. examines the language of marriage in classical Roman law, the Germanic legal codes of early medieval Europe, and the writings of canon lawyers and theologians from the medieval and early modern periods. The heart of the book, however, consists of the writings of the canonists of the High Middle Ages, especially the works of Hostiensis, Bernard of Parma, Innocent IV, and Raymond de Peafort. This study captures the dynamics of the everyday family life of the common people in Roman Egypt, a social strata that constituted the vast majority of any pre-modern society but rarely figures in ancient sources or in modern scholarship. The documentary papyri and, above all, the private letters and the census returns provide us with a wealth of information on these people not available for any other region of the ancient Mediterranean. The book discusses such things as family composition and household size, and the differences between urban and rural families, exploring what can be ascribed to cultural patterns, economic considerations and/or individual preferences by setting the family in Roman Egypt into context with other pre-modern societies where families adopted such strategies to deal with similar exigencies of their daily lives.

This volume is a comparative study of family change in Europe and its dependency on social policy regimes. The authors explore family discourse, family law, single parents, gender relations, the "new fathers", divorce, and abortion within the framework of national policies vis-a-vis the family. Conventional wisdom assumes that policy decisions affecting the life situation of a population shape different opportunities for private living, particularly in relation to children and the family. But, the authors argue, it would be too simplistic to assume a direct causal link between welfare policies for the family and developments in the family sector. Family change is in fact mediated by institutional factors as well as by cultural traditions and political intervention. The chapters in this volume deal with the substantial and methodological problems of ascertaining the impact of different national policy regimes on family change.

The Roman household (familia) was in many respects dramatically different from the modern family. From the early Roman Empire (30 B.C. to about A.D. 250) there survive many legal sources that describe Roman households, often in the most intimate detail. The subject matter of these ancient sources includes marriage and divorce, the property aspects of marriage, the pattern of authority within households, the transmission of property between generations, and the supervision of Roman orphans. This casebook presents 235 representative texts drawn largely from Roman legal sources, especially Justinian's Digest.
